An Act to amend the Airport Authority Act 1985

BE IT ENACTED by the Parliament of the Cook Islands in Session assembled, and by the authority of the same as follows:

1. Short Title

This Act may be cited as the Airport Authority Amendment Act 1994 and shall be read with and deemed part of the Airport Authority Act 1985 (hereinafter referred to as "the principal Act").

2. Board of directors

The principal Act is amended by repealing section 4, and substituting the following new section -

"4. (1) There shall be a board of directors of the Authority consisting of -

• (a) not less than three nor more than five voting members to be appointed by the Minister, one of whom shall be appointed by the Minister as chairman, and at least one of whom shall be appointed as representative of all islands other than the island of Rarotonga; and
• (b) the Director of Civil Aviation ex-officio or, if the Director is not present in the Cook Islands, the Deputy Director.

(2) No person by reason only of being a director of the Authority shall be deemed to be employed in the Public Service within the meaning of the Public Service Act 1975."

3. Meetings of Authority

Section 6 of the principal Act is amended by repealing subsection (5), and substituting the following new subsection -

"(5) At all meetings of the Authority the quorum necessary for the transaction of business shall, where the number of appointed directors is less than 5, be two appointed directors, and in every other case the quorum shall be 3 appointed directors.

4. Savings

Notwithstanding the repeal of section 4 of the principal Act by this Act, and without limiting the provisions of the Acts Interpretation Act 1924, every appointment made pursuant to that section shall continue in force as if that appointment was made pursuant to section 4 of the principal Act as inserted by section 2 of this Act.
