An Act to amend the Airport Authority Act 1985

BE IT ENACTED by the Parliament of the Cook Islands in Session assembled, and by the authority of the same as follows:

1. Short Title

This Act may be cited as the Airport Authority Amendment Act 1989 and shall be read with and deemed part of the Airport Authority Act 1985 (hereinafter referred to as "the principal Act").

2. Board of directors

The principal Act is amended by deleting section 4 and substituting the following new section -

"4. Board of Directors
(1) There shall be a Board of Directors of the Authority.
(2) The Board shall consist of -

• (a) Three directors appointed by the Minister acting on the advice of Cabinet, one of whom shall be appointed as Chairman; and
• (b) One member being a resident of the island of Aitutaki, appointed by the Minister acting in consultation with the Island Council of Aitutaki.

(3) Every director appointed pursuant to subsection (2) shall be a person of recognised competence and experience in financial or commercial matters.
(4) No person by reason only of being a director or employee of the Authority shall be deemed to be employed in the Public Service within the meaning of the Public Service Act 1975.
(5) The following persons shall be "ex officio" members of the Board -

• (a) The Director of Civil Aviation;
• (b) The Airport Manager."

3. Savings

Notwithstanding the repeal of section 4 of the principal Act by this Act, and without limiting the provisions of the Acts Interpretation Act 1924, every appointment made pursuant to that section shall continue in force as if that appointment was made pursuant to section 4 of the principal Act as inserted by section 2 of this Act.

This Act is administered by the Airport Authority.
