AN ACT to amend the Road Traffic Ordinance 1960 to provide for a new schedule of fees.

BE IT ENACTED by the Legislative Assembly of Samoa in Parliament assembled as follows:-

1. Short title and commencement - (1) This Act may be cited as the Road Traffic Ordinance Amendment Act 2002 and shall be read with and form part of the Road Traffic Ordinance 1960 (the principal Act).

(2) This Act shall commence on the date that it is assented to by the Head of State.

(3) A Notice of commencement of the Act shall be published in Samoan and English in the Savali and one other newspaper circulating in Samoa.

2. First Schedule - The First Schedule to the principal Act is repealed and the following substituted:

"FIRST SCHEDULE

ITEM NO. DESCRIPTION OF TYPE OF LICENCE

1. Vehicle Licence issued pursuant to section 9:

(a) For each goods vehicle, tractor, other than for tractors used exclusively in connection with the cultivation or farming of the owner's plantation or farm and used on the road only in proceeding to or from a garage in connection with the servicing or repair of such tractor and trailer.

exceeding 1 but not exceeding 3 $330 plus $8.25 per cwt in excess of 1 ton

exceeding 3 but not exceeding 5 $660 plus $16.50 per cwt in excess of 3 tons

exceeding 5 but not exceeding 8 $1,320 plus $24.75 per cwt in excess of 5 tons

exceeding 8 $2,805 plus $33 per cwt in excess of 8 tons

(b) An additional fee in relation on to a vehicle referred to in item (1)(a) for every 5 cwt net weight of the vehicle or part of every 5 cwt where the vehicle is in total:

(i) 3 tons or less tare weight:

- having an engine capacity up to and including 1500 cc $55 plus $2, per 5 cwt

- having an engine capacity from 1500 cc up to and including 2000 cc $60 plus $25 per 5 cwt

- having an engine capacity from 2,000 cc up to and including 3,000 cc $80 plus $30 per 5 cwt

- having an engine capacity over 3,000 cc $90 plus $35 per 5 cwt

(ii) over 3 tons tare weight $90 plus $40 per 5 cwt or par, thereof

(c) Public Service vehicles other than taxis:

The fee shall be the same as is payable Under item (1)(a) and (b) plus for each passenger the vehicle is licensed to carry $6,00

(d) Taxi and rental vehicles:

(i) having an engine capacity of up to and including 1500 cubic $195

(ii) having an engine capacity from 1501 cubic centimetres up to and including 2000 cubic centimetres $15

(iii) having an engine capacity from 2001 cubic centimetres up to and including 3000 cubic centimetres $265

(iv) having an engine capacity of over 3000 cubic centimetres $290

(e) Private motor vehicles (other than motor cycles and rental vehicles):

(i) having an engine capacity of up to and including 1500 cubic centimetres $195

(ii) having an engine capacity from 1501 cubic centimetres up to and including 2000 cubic centimetres $215

(iii) having an engine capacity from 2001 cubic centimetres up to and including 3000 cubic centimetres $265

(iv) having an engine capacity of over 3000 cubic centimetres $290

(f) Motor cycle (with or without side car) $77

(g) Dealer's licence issued pursuant to section 19 $265

Where any licence mentioned in item 1 is issued for a number of months less than 12, the licence fee shall be the proportion of the appropriate fee above which the number of months covered by the licence bears to 12 months.

2. Driving Licence:

(a) On issue or driving licence pursuant to section 29 $45

(b) On renewal of driving licence for 1 year pursuant to section 32 $45

(c) On endorsement of an international driving licence pursuant to section 27 $15

(d) For practical driving test pursuant to section 30 $22

3. Vehicle licence on first registration issued pursuant to section 13 $90

4. Transfer of vehicle licence pursuant to section 17 $90

5. Duplicate vehicle licence liable under section 12 $22

6. Road service licences-

(a) Application under section 59 in respect of one route for a road service -

Heavy Public Service Vehicle: $165

Light Public Service Vehicle: $132

(b) Road service licence issued pursuant to section 60 for each 6 monthly period -

Heavy Public Service Vehicle: $165

Light Public Service Vehicle: $133

(c) Application fee under section 66 for transfer of road service licence $55

(d) Application fee under section 68 for temporary road service licence for every day for which the licence is applied for $45

(e) Application fee for variations of road service licence $45

(f) Rental fees for public stands, bus stops parking places for every vehicle under section 73- $28

7. Learner's permit issued pursuant to section 28 $ 55

8. Duplicate driving licence issued pursuant to section 32 $33

9. New driving licence without endorsement issued pursuant to section 35 $ 45

10. Registration plates issued pursuant to section 13 for motor cycles, other motor vehicles or trailer $132

11. For the use of an international driving licence $45"
