AN ACT to amend the Crimes Ordinance 1961 to provide for the Ordinance to apply to acts, omissions and events which occur outside Samoa and for related purposes.

BE IT ENACTED by the Legislative Assembly of Samoa in Parliament assembled as follows:-


1. Short title and commencement - (1) This Act may be cited as the Crimes (Extra-Territorial Jurisdiction) Amendment Act 2003 and shall be read with and form part of the Crimes Ordinance 1961 (the Ordinance).


(2) This Act shall commence on the date of assent by the Head of State.


(3) Notice of commencement of this Act shall be published in Samoan and English in the Savali and one other newspaper circulating in Samoa.


2. Extra-territorial jurisdiction - (1) Sections 3 (2), 4, 5, and 6 of the Ordinance are repealed.


(2) Section 3 of the Ordinance is amended by inserting the following after subsection (1):


"(2) This Ordinance applies to any act or omission or event which occurs in Samoa or any other place.


(3) The Court of Appeal and the Supreme Court and the District Court shall have jurisdiction to hear and determine any matter for which this Ordinance or any other law provides such Court with jurisdiction irrespective of the whether any act or omission or event occurs in Samoa or any other place."
