AN ACT to amend the Arms Ordinance 1960 by increasing fines and penalties for offences against the Act.

BE IT ENACTED by the Legislative Assembly of Samoa in Parliament assembled as follows:-

1. Short title and commencement-(1) This Act may be cited as the Arms Amendment Act 1999 and shall be read with and form. part of the Arms Ordinance 1960 (the "principal Act").

(2) This Act shall come into force on the date it is assented to by the Head of State.

2. Amendment to fines and custodial penalties - The principal Act is amended by deleting the fines and custodial penalties prescribed in the sections specified in Column A of the Schedule, and replacing them with the fines and custodial penalties specified in Column B of the Schedule.

3. Dealers in arms and ammunition to be licensed subsection (5)	fine not exceeding 50 penalty units or imprisonment for a term not exceeding 5 years, or to both such fine and imprisonment
4. Records of dealings by licensed dealers subsection (3)	fine not exceeding 20 penalty units.
6. Permits for import of firearms subsection (6)	imprisonment for a term not exceeding 5 years or to a fine not exceeding 200 penalty units, or to both such fine and imprisonment.
7. Permits for possession subsection (4)	imprisonment for a term not exceeding 2 years or to a fine not exceeding 20 penalty units, or to both such fine and imprisonment.
8. Sale to and possession by young persons of firearms and ammunitions subsection (3)	fine not exceeding 50 penalty units.
8A. Sale of fireworks to children subsection (2)	fine not exceeding 20 penalty units.
9. Registration of firearms subsection (8) and (11)	imprisonment for a term not exceeding 2 years or to a fine not exceeding 50 penalty unit, or to both such fine and imprisonment
11. Unregistered firearms to be surrendered to police subsection (3)	imprisonment for a term not exceeding 2 years or to a fine not exceeding 50 penalty units, or to both such fine and imprisonment.
12. Possession of Unlawful weapon subsection (3)	imprisonment for a term not exceeding 5 years or to a fine not exceeding 100 penalty units, or to both such fine and imprisonment.
13. Carriage or possession of arms, ammunition or explosives, except for proper purposes, prohibited subsection (4)	imprisonment for a term not exceeding 2 years or to a fine not exceeding 50 penalty units, or to both such fine and imprisonment.
14. Unlawful acquisition of firearms, ammunition or explosives	imprisonment for a term not exceeding 2 years or to a fine not exceeding 50 penalty units, or to both such fine and imprisonment.
15. Presenting firearms at other persons	imprisonment for a term not exceeding 2years or to a fine not exceeding 50 penalty units, or to both such fine and imprisonment.
16. Obstruction of Police	imprisonment for a term not exceeding 1yearor to a fine not exceeding 20 penalty units, or to both such fine and imprisonment
18. Offences by companies	Fine not exceeding 100 penalty units.
