AN ACT to amend the Apprenticeship Act 1972.

[8 July 1994]

BE IT ENACTED by the Legislative Assembly of Western Samoa in Parliament assembled as follows:-

1. Short Title-(1) This Act may be cited as the Apprenticeship Amendment Act 1994 and shall be read together with and deemed part of the Apprenticeship Act 1972 (hereinafter referred to as the principal Act).

(2) This Act shall come into force on the day upon which it is assented to by the Head of State.

2. Administration of Act -Subsection (2) of section 3 of the principal Act is amended by omitting the words "Department of Education" appearing in the second line of the subsection and substituting the words "Western Samoa Polytechnic".

3. Establishment of Apprenticeship Council Section 4 of the principal Act is amended by:-

(a) omitting the words "Principal of the Trades Training Institute" appearing in paragraph (f) of subsection (2) and substituting the words "Chief Executive Officer of the Western Samoa Polytechnic."

(b) omitting the words "Director of Education" appearing in subsection (5) and substituting the words "Chief Executive Officer of the Western Samoa Polytechnic"

(c) omitting from subsection (13) the words "who are not full-time salaried employees of Government" appearing in the first and second line of the subsection.

4. Functions of the Council-Section 5 of the principal Act is amended by:

(a) Inserting into paragraph (f) after the words "progress certificates to apprentices" appearing in the first line of the subsection, the words "or other trades persons."

(b) omitting from line 1 of paragraph (g) the words "Ministers of Labour and of Education" and substituting the words "Minister of Labour" and omitting from the last and second to last lines of the section the words "by either of such Ministers" and substituting the words "by the Minister."

5. Panels of Trade Advisers -Section 10 of the principal Act is amended by omitting from the first and second lines of subsection (3) the words "who are not full-time salaried employees of Government."

6. Subcommittees-Section 11 of the principal Act is amended by omitting from the first and second lines of subsection (2) the words "who are not full-time salaried employees of Government."

7. Minimum age and educational requirements-Section 12 of the principal Act is amended by omitting from subsection (2) the words "a 2 year preliminary trade course at the Trades Training Institute" and substituting the words "the equivalent of Form V or Level II.

8. Penalties-Section 31 of the principal Act is amended by;

(a) omitting from subsection (1) the amount of "$100" and substituting the amount of "$500".

(b) omitting from subsection (2) the amount of "$1" and substituting the amount of "$10".

(c) omitting from subsection (3) the amount of "$100" and substituting the amount of "$500".
