AN ACT to set out electoral constituencies and villages under each constituency.
[Assent date: 31 January 2019]
[Commencement date: Section 4 commences on 31 January 2019. The whole Act commences on the day the Head the Head of State dissolves the Legislative Assembly under Article 63(4) of the Constitution of the Independent State of Samoa].
BE IT ENACTED by the Legislative Assembly of Samoa in Parliament assembled as follows:
(1) This Act may be cited as the Electoral Constituencies Act 2019.
(2) Except for section 4, which commences on the date of assent of this Act, this Act commences on the day the Head of State dissolves the Legislative Assembly under Article 63(4) of the Constitution of the Independent State of Samoa (“Constitution”).
(1) For the purpose of Article 44(1) of the Constitution, the 51 Electoral constituencies for the election of members of the Legislative Assembly are named in the Schedule.
(2) Each Electoral Constituency comprises of a list of villages and sub villages.
(1) Whenever the boundaries of constituencies are required to be reviewed, the Head of State acting on the recommendation of the Cabinet may appoint not more than three (3) members to review the boundaries and provide a report to the Legislative Assembly and Cabinet for its approval and implementation.
(2) The Commission must provide administrative support to the Committee when carrying out the review.
The Constituencies Act 1963 is repealed.
For the purpose of the compilation of rolls for the electoral constituencies under the Electoral Act 2019 as prescribed in this Act, the 51 electoral constituencies are lawfully recognized only for that purpose at the commencement of this Act.
