BAD DEBTS ACT 1990

AN ACT to write off certain debt and investment balances due to the Treasury Fund together with accrued interest thereon.

[Assent and commencement date: 30 July 1990]


1. Short title – This Act may be cited as the Bad Debts Act 1990.


2. Irrecoverable debts written off(1) The debts, together with interest thereon, and investment balances due to the Treasury Fund as set out in the Schedule being considered to be irrecoverable are written off.
(2) Nothing in this Act operates to extinguish the liability of a debtor for payment of any debt, interest or investment balance written off by this Act.

REVISION NOTES 2008 – 2019


This is the official version of this Act as at 31 December 2019.


This Act has been revised by the Legislative Drafting Division from 2008 –
2019 respectively under the authority of the Attorney General given under the Revision and Publication of Laws Act 2008.


The following general revisions have been made:

(a) Amendments have been made to conform to modern drafting styles and to use modern language as applied in the laws of Samoa.

(b) Amendments have been made to up-date references to offices, officers and statutes.

(c) Insertion of the commencement date (being the date of assent)

(d) Other minor editing has been done in accordance with the lawful powers of the Attorney General.

(i) “shall be” changed to “is”
(ii) “notwithstanding” changed to “despite”
(iii) “hereby” removed
(iv) Authorising section of the Schedule to the Act is inserted in the Schedule (under its heading “Schedule”),
(v) Correction of typographical errors (e.g. in section 1, for “cites” substituted “cited”).

There were no amendments to this Act since the publication of the Consolidated and Revised Statutes of Samoa 2007.
