THE TERRITORIAL CONSTITUENCIES ACT 1963
1963 No. 15


AN ACT to define the territorial constituencies for the election of Members of Parliament, and to prescribe the 6 territorial constituencies entitled to elect one additional Member each.

1. Short title - This Act may be cited as the Territorial Constituencies Act 1963.


2. Prescribing territorial constituencies - The 41 territorial constituencies referred to in Article 44(1)(a) of the Constitution of the Independent State of Samoa, as substituted by section 2 of the Constitution Amendment Act 1963, shall have the names and boundaries and include the villages or sub-villages or villages and sub-villages set forth in the Schedule hereto.


3. Prescribing 6 territorial constituencies entitled to elect one additional Member each - The 6 territorial constituencies entitled each to elect one of the 6 additional Members of Parliament referred to in Article 44(1) (aa), as substituted by section 2 of the Constitution Amendment Act 1963, as amended by the Constitution Amendment Act 1991, shall be the territorial constituencies of Vaimauga West, Falealili, A'ana North No. 1, Fa'asaleleaga No. 1, Safata and Salega.


4. Repeals - (1) The Faipule Election Ordinance 1939, and the Faipule Election Amendment Ordinance 1960, are hereby repealed.


(2) Sections 21 to 26 inclusive, 28, 29, 31, 32 and 34 to 41 inclusive of the Samoa Amendment Act 1957 (N.Z.) and sections 3 to 22 inclusive of the Samoa Amendment Act 1959 (N.Z.) shall cease to have effect as part of the law of Samoa.


(3) The provisions of sections 19 and 20 of the Acts Interpretation Act 1974 shall apply to the sections cited in subsection (2) of this section as if they had been repealed by this section.

Section 2


CONSTITUENCY No. 1 - VAIMAUGA EAST


All that area of land bounded as follows:


Commencing on the coast at the boundary of Fagali'i and Matafagatele villages and continuing by the said boundary to its southern end thence in a generally southerly direction to the intersection of the boundaries of Court Grants 132 & 997 and Parcel 52 Flur XII, Upolu, thence in a generally easterly direction to Mount Fito, thence in a generally north-easterly direction to the boundary between Lauli'i and Leusoali'i villages, thence by the said boundary to the coast and thence along the coast to the point of commencement and includes the villages of Lauli'i, Letogo, Vailele and Fagali'i.


CONSTITUENCY No. 2 - VAIMAUGA WEST


All that area of land bounded as follows:


Commencing on the coast at the mouth of the Asaga Stream and continuing along the Asaga Stream to Fugalei Street, thence in a generally southerly direction along Fugalei Street to Vaitele Street, thence in a generally westerly direction to Vaimoso Road, thence by the said Road to the Gasegase Stream, thence by the said Stream to Moamoa Road, thence in a generally south-westerly direction by the said Road to the Ala-i-Sa track, thence in a generally south-westerly direction by the said track to its intersection with the Public Road abutting Parcels 14 and 15 Flur IX, Upolu, thence in a generally easterly direction to the south west corner of the Vaimauga East Electoral District, thence by the western boundary of the Vaimauga East Electoral District to the coast and thence by the coast back to the point of commencement and includes the villages and sub-villages of Matafagatele, Magiagi, Vaiala, Matautu, Apia, Tanugamanono, Taufusi, Vaimea, Fugalei, Saleufi, Sogi, Mulinu'u, Papauta, Vailima, Tanumaleko, Moto'otua, Lalovaea, Fa'ato'ia and part of Alamagoto.


CONSTITUENCY No. 3 - FALEATA EAST


All that area of land bounded as follows:


Commencing on the coast at the eastern boundary of Vaimauga West Electoral District and continuing in a generally south-westerly direction by the said boundary to its intersection with the Safata Electoral District boundary, thence in a generally west north-westerly direction along the Safata Electoral District boundary to the eastern side of Lake Lanuto'o, thence in a generally north-easterly direction to the southern end of the boundary between the Vaiusu and Vailoa villages, thence by the said boundary to the coast and thence by the coast back to the point of commencement and includes the villages of Vaimoso, Lepea, Vailoa and part of Alamagoto.


CONSTITUENCY No. 4 - FALEATA WEST


All that area of land bounded as follows:


Commencing on the coast at the boundary between Faleula and Puipa'a villages and continuing along the said boundary to its southern end, thence in a generally southerly direction to the intersection with the northern boundary of the Safata Electoral District at the eastern slope of Mount Sigaele, thence in a generally south-easterly direction to the south west corner of the Faleata East Electoral District thence by the western boundary of the said Electorate to the coast and thence along the coast back to the point of commencement, and includes the villages and sub-villages of Vaiusu, Vaitele, Toamua, Safune and Puipa'a.


CONSTITUENCY No. 5 - SAGAGA (LE FALEFA)


All that area of land bounded as follows:


Commencing on the coast at the western boundary of the Faleata West Electoral District and continuing in a generally south-westerly direction by the said boundary to its intersection with the Safata Electoral District boundary, thence in a generally westerly direction to the boundary intersection of Court Grants 200 and 115 and Parcel 412 Flur XV, Upolu, and thence in a generally northerly direction to the southern end of the boundary between the Faleasi'u and Tufulele villages, thence along the said boundary to the coast, thence along the coast to the western boundary of Gagaemauga No. 1 Electoral District, thence by the said boundary to its south east corner, thence in a generally south-easterly direction to the intersection of the boundaries of Parcels 298 and 302 Flur XIII, Upolu, and the Foga'a Road, thence in a generally northerly direction by the Foga'a Road to the Faleula Road, thence by the Faleula Road to the Main West Coast Road, thence in a generally south-easterly direction to the boundary of Parcels 7 and 12 Flur XI, Upolu, thence by the said boundary to the coast and then along the coast back to the point of commencement, and includes the villages and sub-villages of Tufulele, Sale'imoa, Faleula, Utuali'i, Tofuola, Nonoa, Salepoua'e, Lotoso'a, Alamutu, Solomonafou, Levi and Aleisa.


CONSTITUENCY No. 6 - SAGAGA (LE USOGA)


All that area of land bounded as follows:


Commencing on the coast at the boundary of the Sagaga (Le Falefa) Electoral District between the villages of Vailoa and Faleula and continuing in a generally south-westerly direction along the said boundary thence in a generally westerly direction along this boundary to the south-east corner of the Gagaemauga No.1 Electorate, thence along the eastern boundary of the Gagaemauga No. 1 Electoral District to the coast and thence along the coast back to the point of commencement and includes the villages of Vailoa, Vaifoa, Malie, Afega and Tuana'i.


CONSTITUENCY No. 7 - A'ANA NORTH No. 1


All that area of land bounded as follows:


Commencing on the coast at the western boundary of the Sagaga (Le Falefa) Electoral District and continuing by the said boundary to its junction with Lefaga and Falese'ela, Safata Electoral Districts, thence in a generally westerly direction by the northern boundary of the Lefaga and Falese'ela Electoral District for a distance of 1,600 metres, and thence in a generally north-westerly direction to the boundary between the Nofoali'i and Fasito'outa villages, thence by the said boundary to the coast and thence back to the point of commencement and includes the villages and sub-villages of Faleasi'u and Fasito'outa, Satui, Mataili'ili, Tauao'o and Sapulu.


CONSTITUENCY No. 8 - A'ANA NORTH No. 2


All that area of land bounded as follows:


Commencing on the coast at the western boundary of the A'ana Alofi No. 1 Electoral District and continuing by the said boundary to its south west corner, thence in a generally north-westerly direction to the intersection of the boundary of Court Grant 224 and the Leulumoega and Fasito'otai Village boundary, thence by the village boundary to the coast and thence along the coast to the point of commencement and includes the villages of Leulumoega and Nofoali'i.


CONSTITUENCY No. 9 - A'ANA NORTH No. 3


All that area of land bounded as follows:


Commencing at a place on the coast called Paepae'ala and proceeding thence in a generally south-easterly direction along the Afolau Road to Mount Afolau, thence in a generally easterly direction to the south west corner of the A'ana Alofi No. 2 Electoral District, thence by the western boundary of the said Electoral District to the coast and thence along the coast to the point of commencement and includes the villages and sub-villages of Sagafili, Toloa, Faleolo, Satapuala, Ulutauvalu, Magia, Faleatiu, Vailu'utai and Fasito'otai.


And all those areas of land comprising the seaward and inland lands of the village of Satuimalufilufi, being also part of Court Grant No. 92 and being also all those lands bordered green on plans Nos. 2271 and 2272 deposited in the Office of the Director of Lands at Apia.


CONSTITUENCY No. 10 - AIGA-I-LE-TAI


All that area of land bounded as follows:


Commencing at a place on the coast called Paepaeala and proceeding thence by the western boundary of A'ana Alofi No. 3 Electoral District to Mount Afolau, thence in a generally south westerly direction to a point on the coast on line with the southern most boundary of Court Grant 92, excluding therefrom the village lands of Samatau and Satuimalufilufi (as the latter are described and included in Constituency No. 9) and thence along the coast to the point of commencement and includes the villages and sub-villages of Samea, Fuailolo'o, Mulifanua, Lalovi, Matautu, Levi, Matanofo, Falevai and Sama'i, Apolimafou, Falepuna and Manonouta; and


All that area of land comprising the Island of Manono and includes the villages of Faleu, Salua, Apai and Lepuia'i; and


All that area of land comprising the Island of Apolima.


CONSTITUENCY No. 11 - FALELATAI AND SAMATAU


All that area of land bounded as follows:


Commencing on the coast at the southern boundary of the Aiga-I-Le-Tai Electoral District and proceeding by the said boundary in a generally north-easterly direction to its intersection with the southern boundary of the A'ana Alofi No. 3 Electoral District, thence by the southern boundary of the A'ana Alofi No. 3 Electoral District to its intersection with the southern boundary of the A'ana Alofi No. 2 Electoral District, thence in a generally south-westerly direction to a place on the coast called Cape Mulitapuili but excluding therefrom the village lands of Matafa'a and Falese'ela and thence along the coast back to the point of commencement and includes the villages and sub-villages of Samatau, Si'ufaga, Pata, Nefunefu, Matautu, Levi, Matanofo, Falevai and Sama'i.


CONSTITUENCY No. 12 - LEFAGA AND FALESE'ELA


All that area of land bounded as follows:


Commencing on the coast at the eastern boundary of the Falelatai and Samatau Electoral Districts, thence in a generally south-easterly direction by the southern boundaries of the A'ana Alofi No.2 Electoral District and A'ana Alofi No. 1 Electoral District to the junction with Sagaga (Le Falefa) and Safata Electoral Districts, thence in a generally southerly direction to the north-east corner of the Gagaemauga No. 2 Electoral District, thence by the north and west boundaries of the said Electoral District to the coast and thence along the coast back to the point of commencement and includes the villages and sub-villages of Matafa'a, Falease'ela, Safa'ato'a, Tafagamanu, Savaia, Vaiana, Gagaifoolevo, Matautu and Vaeoleala.


CONSTITUENCY No. 13 - SAFATA


All that area of land bounded as follows:


Commencing on the south coast at the eastern boundary of Gagaemauga No. 2 Electoral District and proceeding in a generally northerly direction along the said boundary to its junction with the Lefaga and Falease'ela Electoral District, thence in a generally northerly direction by the said Lefaga and Falease'ela Electoral District boundary to the junction with A'ana Alofi No.1, Sagaga (Le Falefa) Electoral District, thence in a generally easterly direction by the southern boundaries of Sagaga (Le Falefa), Faleata West, Faleata East and Vaimauga West Electoral Districts to the Afiamalu Si'umu Road, thence in a generally southerly direction to the boundary between Maninoa and Mulivai villages excluding therefrom the village lands of Si'umu thence by the said boundary to the coast and thence along the coast back to the point of commencement and includes the villages of Sa'anapu, Sataoa, Lotofaga, Nu'usuatia, Vaie'e, Fusi, Fausaga, Tafitoala and Mulivai.


CONSTITUENCY No. 14 - SI'UMU


All that area of land bounded as follows:


Commencing on the coast at the eastern boundary of the Safata Electoral District and proceeding in a generally northerly direction by the said boundary to its intersection with the southern boundary of the Vaimauga West Electoral District thence generally in a south-easterly direction by the southern boundaries of the Vaimauga West and Vaimauga East Electoral Districts to the south-east corner of the Vaimauga East Electoral District, thence in a generally southerly direction to a point called Togitogiga on the Main South Coast Road, thence in the same direction to the coast and thence along the coast back to the point of commencement and includes the villages and sub-villages of Si'umu, Maninoa, Sa'aga, Sa'agafou and Aganoa.


CONSTITUENCY No. 15 - FALEALILI


All that area of land bounded as follows:


Commencing on the coast at the eastern boundary of the Si'umu Electoral District and proceeding thence by the said boundary to its junction with the Vaimauga East and Anoama'a West Electoral District, thence in a generally east south easterly direction to the north-east corner of Court Grant 220 near the Le Mafa Pass, thence in a generally southerly direction by the boundary of the said Court Grant to its south-east corner abutting Court Grant 219, thence by the eastern boundary of Court Grant 219 to its southern boundary, thence in a generally southerly direction to the northern boundary between the villages of Sapo'e and Letaupe, thence by the said boundary to the coast and thence along the coast back to the point of commencement and includes the villages and sub-villages of Saleilua, Poutasi, Vaovai, Matautu, Gaogao, Vaiula, Tafatafa, Matavai, Malaemaulu, Satalo, Sapunaoa, Faleulu, Salesatele, Salani, Utulaelae and Sapo'e.


CONSTITUENCY No. 16 - LOTOFAGA


All that area of land bounded as follows:


Commencing on the coast at the eastern boundary of Falealili Electoral District and proceeding thence in a generally northerly direction by the said boundary to its junction with Va'a o Fonoti and Anoama'a East Electoral Districts thence in a generally south-easterly direction along the Vaigafa Road to the junction with Richardson's Track, thence along Richardson's Track for a distance of 3,000 metres thence in a generally south south easterly direction to the boundary between Vavau and A'ufaga villages thence by the said boundary to the coast and thence along the coast to the point of commencement and includes the villages of Letaupe, Matatufu, Lotofaga, Etemuli and Vavau.


CONSTITUENCY No. 17 - LEPA


All that area of land bounded as follows:


Commencing on the coast at the eastern boundary of the Lotofaga Electoral District and proceeding in a generally north north westerly direction by the said boundary to the north-east corner of the Lotofaga Electoral District thence continuing on a bearing of 111 degrees for a distance of 8,000 metres, thence in a generally south south westerly direction to the eastern boundary of the Saleapaga village, thence by the said boundary to the coast and thence along the coast back to the point of commencement and includes the villages and sub-villages of A'ufaga, Vaigalu, Lepa, Si'upapa and Saleapaga.


CONSTITUENCY No. 18 - ALEIPATA (ITUPA-I LUGA)


All that area of land bounded as follows:


Commencing on the coast at the eastern boundary of the Lepa Electoral District and proceeding by the said boundary to the north-east corner of the Lepa Electoral District, thence in a generally south-easterly direction to the boundary between the villages of Ulutogia and Satitoa, thence by the said boundary to the coast and thence by the coast back to the point of commencement and includes the villages and sub-villages of Lefaga, Lata, Matautu, Lalomanu, Vailoa and Ulutogia.


And all that area of land comprising the islands of Nu'utele and Nu'ulua.


CONSTITUENCY No. 19 - ALEIPATA (ITUPA-I-LALO)


All that area of land bounded as follows:


Commencing on the coast at the northern boundary of Aleipata (Itupa-I-Lalo) Electoral District and proceeding thence by the said boundary to its junction with the north and east boundaries of the Lepa Electoral District thence by the northern boundary of the Lepa Electoral District for a distance of 4,200 metres, thence in a north-easterly direction to the coast and thence along the coast back to the point of commencement and includes the villages and sub-villages of Ti'avea, Amaile, Samusu Utufaalalafa, Salea'aumua, Mutiatele and Satitoa.


And all that area of land comprising the islands of Fanuatapu and Namu'a.


CONSTITUENCY No. 20 - VA'A O FONOTI


All that area of land bounded as follows:


Commencing on the coast at the western boundary of the Aleipata (Itupa -I-Lalo) Electoral District and proceeding by the said boundary to its intersection with the northern boundary of the Lepa Electoral District, thence by the northern boundaries of the Lepa and Lotofaga Electoral Districts, to the junction of the Lotofaga, Falealili, and Anoama'a East Electoral Districts, thence in a generally north north easterly direction by the road and the mountain ridge to Mount Fao, thence in a generally north-easterly direction by the mountain ridge to Utuloa Point and thence by the coast back to the point of commencement and includes the villages and sub-villages of Musumusu and Salimu, Ta'elefaga, Maasina, Lona, Samamea and Uafato;


And all that area of land within the boundaries of Faleapuna Village on the north coast of Upolu.


CONSTITUENCY No. 21 - ANOAMA'A EAST


All that area of land bounded as follows:


Commencing on the coast at the western boundary of Va'a-o-Fonoti Electoral District and proceeding in a generally south-westerly direction by the said boundary to its junction with Lepa and Falealili Electoral Districts, thence by the northern boundary of Falealili Electoral District for a distance of 3,200 metres, thence in a generally north north easterly direction to the boundary between the villages of Saluafata and Lufilufi, thence by the said boundary to the coast but excluding therefrom the village lands of Solaua, thence along the coast to the western boundary of Faleapuna village, thence inland by the boundary of Faleapuna village, thence proceeding by the Faleapuna village boundary back to the coast and thence by the coast back to the point of commencement and includes the villages and sub-villages of Lufilufi, Falefa, Falevao, Lalomauga, Manunu, Sauago and Saletele.


CONSTITUENCY No. 22 - ANOAMA'A WEST


All that area of land bounded as follows:


Commencing on the coast at the western boundary of Anoama'a East Electorate and proceeding by the said boundary to its intersection with the northern boundary of the Falealili Electoral District thence by the northern boundary of the Falealili Electoral District to its junction with the Si'umu and Vaimauga East Electoral District, thence by the eastern boundary of the Vaimauga East Electoral District to the coast and thence by the coast back to the point of commencement and includes the villages and sub-villages of Leusoali'i, Luatuanu'u, Solosolo, Eva, Salelesi, Fusi, Solaua and Saluafata.


CONSTITUENCY No. 23 - FA'ASALELE'AGA No. 1


All that area of land bounded as follows:


Commencing at the mouth of the Sataelea Stream at Avalua and proceeding thence on a bearing of 275 degrees for a distance of 10,800 metres excluding therefrom the village land of Sapapali'i, thence generally on a bearing of 150 degrees to the intersection with the Main West Coast Road thence on a bearing of 190 degrees for a distance of 1,500 metres, thence on a bearing of 122 degrees to the coast, thence along the coast to the place of commencement and includes the villages and sub-villages of Salelologa, Sapulu, Satalafai, Malaeta, Foa, Saletagaloa, Salelavaluitai, Faleapuse, Sanave, Vaifou, Tino-i-tau, Vao-o-Iva, Vaiafai, Lalomalava, Safua and Avalua.


CONSTITUENCY No. 24 - FA'ASALELE'AGA No. 2


All that area of land bounded as follows:


Commencing at a point on the coast at the northern boundary of Fa'asalele'aga No. 1 Electoral District, thence by the said boundary to the north-west corner of Fa'asalele'aga No. 1 Electoral District thence on a bearing of 330 degrees for a distance of 8,000 metres to Mount Mataulano thence on a bearing 87 degrees 6,800 metres thence generally south-easterly direction to the south-east corner of Court Grant 907 thence south-easterly Mount Viala thence in an easterly direction to the boundary on the coast between Si'ufaga and Tuasivi villages excluding therefrom the village lands of Si'ufaga thence along the coast to the point of commencement, and includes the villages and sub-villages of Safotulafai, Sapapali'i, Tuasivi, Fogapoa, Fatausi, Fuifatu, Fusi, Eve'eve, Vaimaga, Vaitolo and A'eauli.


CONSTITUENCY No. 25 - FA'ASALELE'AGA No. 3


All that area of land bounded as follows:


Commencing on the boundary on the coast between Si'ufaga and Tuasivi villages thence proceeding by the eastern boundary of Fa'asalele'aga No. 2 Electorate to the north-east corner, thence in a generally easterly direction to Utumalama Point and thence along the coast to the point of commencement and includes the villages and sub-villages of Faga, Saipipi, Sa'asa'ai, Salimu, Malae, Lu'ua, Sapini and Si'ufaga.


CONSTITUENCY No. 26 - FA'ASALELE'AGA No.4


All that area of land bounded as follows:


Commencing at a place on the coast called Papalaulelei thence proceeding generally in a westerly direction to the edge of the lava on the northern side of the old village site of Le'uo, thence continuing in a westerly direction to the junction of the inland track, Puna track, and the track to the old Le'uo village, thence in a southerly direction to Mount Mataulano thence in an easterly direction by the northern boundaries of Fa'asalele'aga No. 2 and Fa'asalele'aga No. 3 Electoral Districts to the coast thence along the coast to the place of commencement, and includes the villages of Asaga, Lano and Pu'apu'a.


The Constituencies described as Fa'asalele'aga Nos. 1, 2, 3 and 4 form the Fa'asalele'aga Water Supply District. See s.2 of the Fa'asalele'aga Water Supply Act 1969. See notes to District Wharf Regulations (Salelologa) 1959, r. 2 (in title Shipping).


CONSTITUENCY No. 27 - GAGAEMAUGA No. 1


All that area of land bounded as follows:


Commencing at a place on the coast called Papalaulelei, thence proceeding generally in a westerly direction to the edge of the lava on the northern side of the old village site of Le'uo, thence continuing in a westerly direction generally to the junction of the inland track, Puna track, and the track to the old Le'uo village, thence southerly generally to the boundary of Fa'asalele'aga and Palauli East Electoral Districts at Mt. Mataulano, excluding therefrom the old village site of Puna and Puna spring, thence westerly generally by the electoral boundary of Palauli East to its junction with Saleaula and Lealatele Electoral Districts, thence northerly generally to the boundary of Mauga and Saleaula villages, thence continuing northerly and north-easterly generally by the said village boundaries to the sea coast, thence south-easterly generally by the sea coast to the point of commencement.


And all that area of land bounded as follows:


Commencing at a point on the northern sea coast on the boundary between Leauva'a and Tuana'i villages, thence southerly generally by that boundary to the Laumasa Road, thence westerly generally by the Laumasa Road to the boundary between Levi and Leauva'a villages, thence continuing westerly and northerly generally by the said boundary to the sea coast, thence easterly generally by the sea coast to the point of commencement.


CONSTITUENCY No. 28 - GAGAEMAUGA No. 2


All that area of land bounded as follows:


Commencing at a point on the sea coast on the boundary between Safa'i and Saleaula villages, thence southerly generally by the said boundary to the lava field, thence southerly generally to the junction of the Palauli West, Satupa'itea, and Saleaula Electoral Districts, thence easterly generally by the northern boundary of the Satupa'itea Electoral District to its junction with Palauli East, Saleaula, and Lealatele Districts, thence northerly generally to the boundary of Saleaula village, thence continuing northerly and north-easterly generally by the said village boundaries to the sea coast, thence westerly generally by the sea coast to the point of commencement.


And all that area of land bounded as follows:


Commencing at a point on the south coast on the boundary between Matautu Lefaga and Salamumu villages, thence north-easterly generally by the said boundary to the Salamumu Road and thence northerly generally along the said road to the Main South Coast Road, thence south-easterly generally by the said Main South Coast Road to the boundary between Sa'anapu and Salamumu villages, thence southerly generally by the said village boundary to the south coast, thence westerly generally by the south coast to the point of commencement.


CONSTITUENCY No. 29 - GAGAEMAUGA No. 3


All that area of land bounded as follows:


Commencing at a point on the coast at the boundary between Safa'i and Saleaula villages, thence generally southerly by the western boundary of Gagaemauga No. 2 Electoral District to the south-west corner of Gagaemauga No. 2 Electoral District thence on a bearing of 271 degrees for a distance of 1,200 metres, thence in a generally northerly direction to the boundary between Manase and Sale'ia villages, thence by the said boundary to the coast thence along the coast to the point of commencement and includes the villages of Safa'i, Sato'alepai, Fagamalo, Lelepa and Avao.


CONSTITUENCY No. 30 - GAGAIFOMAUGA No. 1


All that area of land bounded as follows:


Commencing on the coast at the western boundary of Gagaemauga No. 3 Electoral District, thence in a generally southerly direction by the said boundary of Gagaemauga No. 3 to its junction with the southern boundary of Gagaemauga No. 3 thence on a bearing of 271 degrees for a distance of 900 metres, thence in a northerly direction to Paia and Samauga road thence by the said road to the coast and thence along the coast to the point of commencement, and includes the villages of Manase and Safotu.


CONSTITUENCY No. 31 - GAGAIFOMAUGA No. 2


All that area of land bounded as follows:


Commencing on a point on the coast at the western boundary of Gagaifomauga No. 1 Electoral District thence proceeding by the said boundary generally in a southerly direction to the south-west corner of Gagaifomauga No. 1 Electoral District thence on a bearing of 271 degrees for a distance of 2,700 metres, thence generally in a northerly direction to the boundary between Fatuvalu and Fagae'e villages, thence along the said boundary to the coast and thence along the coast back to the point of commencement and includes the villages and sub-villages of Paia, Samauga, Lefagaoali'i, Leagiagi, Fatuvalu, Faletagaloa, Saletele, Lolua, Si'ufaga and Matavai.


CONSTITUENCY No. 32 - GAGAIFOMAUGA No. 3


All that area of land bounded as follows:


Commencing at a place on the coast called Tatania thence in a generally southerly direction to Mount Elietoga thence in a generally easterly direction to the Crater Teio thence in a generally easterly direction to the south-west corner of the Gagaifomauga No. 2 Electoral District thence by the western boundary of the said Electoral District to the coast and thence along the coast to the place of commencement and includes the villages and sub-villages of Fagae'e, Sasina, Letui and A'opo.


CONSTITUENCY No. 33 - VAISIGANO No. 1


All that area of land bounded as follows:


Commencing on the coast at the western boundary of Gagaifomauga Electoral District and proceeding by the said boundary to Mount Elietoga, thence in a generally north westerly direction to Mount Maile, thence in a generally north-easterly direction to a place on the coast called Fagasua and thence along the coast back to the place of commencement and includes the villages and sub-villages of Vaisala, Auala, Asau, Utuloa and Matavai.


CONSTITUENCY No. 34 - VAISIGANO No. 2


All that area of land bounded as follows:


Commencing on the coast at the western boundary of Vaisigano No.1 Electoral District and proceeding by the said boundary to Mount Maile thence in a generally north-westerly direction to the junction of the Falealupo Road with the Main Cross Island Road thence a generally north-westerly direction to Cape Puava and thence along the coast to the point of commencement and includes the villages and sub-villages of Fagasa, Sataua and Papa.


CONSTITUENCY No. 35 - FALEALUPO


All that area of land bounded as follows:


Commencing on the coast at the western boundary of Vaisigano No. 2 Electoral District and proceeding by the said boundary to the junction of the Falealupo Road and the Main Cross Island Road thence in a generally westerly direction to Cape Mulinu'u excluding therefrom the village land of Tufutafoe and thence along the coast back to the point of commencement and includes the villages of Vaitupua and Avata.


CONSTITUENCY No. 36 - ALATAUA WEST


All that area of land bounded as follows:


Commencing on the coast at the southern boundary of Falealupo Electoral District and proceeding thence by the said boundary in a generally easterly direction to its intersection with the southern boundary of Vaisigano No. 2 and thence by the southern boundary of the Vaisigano No. 2 Electoral District to Mount Maile thence by the southern boundary of Vaisigano No. 2 Electoral District for a distance of 7,100 metres thence in a generally south-westerly direction to the boundary between the villages of Fagafau and Si'uvao thence by the said boundary to the coast and thence along the coast back to the point of commencement and includes the villages of Tufutafoe, 'Auta, Alela'i, Neiafu, Falelima and Si'uvao.


CONSTITUENCY No. 37 - SALEGA


All that area of land bounded as follows:


Commencing on the coast at the eastern boundary of Alataua West Electoral District and proceeding by the said boundary to its intersection with the southern boundary with Vaisigano No. 1 Electoral District thence by the southern boundary of the Vaisigano No. 1 Electoral District to Mount Elietoga thence in a generally south-easterly direction to Crater Teio thence generally south-westerly the boundary between Sagone and Fualilalo villages, thence by the said boundary to the coast, thence along the coast to the point of commencement and includes the villages and sub-villages of Fagafau, Samataitai, Samataiuta, Fogatuli, Fai'a'ai, Vaipu'a, Fogasavai'i and Sagone.


CONSTITUENCY No. 38 - PALAULI WEST


All that area of land bounded as follows:


Commencing on the coast at the eastern boundary of Salega Electoral District and proceeding thence by the said boundary to the Crater Teio thence by the southern boundary of Gagaifomauga No. 3 to its intersection with Gagaifomauga No. 2 and Gagaifomauga No. 1 Electoral Districts to the junction of Gagaifomauga No. 1 and Gagaifomauga No. 3 and Palauli (Falefa) Electoral Districts, thence in a generally southerly direction to the boundary between Nu'u and Gataivai thence by the said boundary to the coast and thence along the coast to the point of commencement and includes the villages and sub-villages of Foailalo, Foailuga, Satuiatua, Gagaemalae, Sala'ilua, Sataputu, Si'utu, Lataitai, Fagaloa, Taga and Nu'u.


CONSTITUENCY NO. 39 - SATUPA'ITEA


All that area of land bounded as follows:


Commencing on the coast at the boundary between Papa and Satufia villages and proceeding by the said boundary to its northern end thence in a generally north westerly direction to the junction with Gagaifomauga No. 3 and No. 2 and Palauli (Le Falefa) Electoral Districts, thence by the southern boundary Gagaifomauga No. 2 Electoral District to the junction with Gagaifomauga No. 1 and Palauli Electoral Districts, thence in a generally south-easterly direction to the eastern junction of the Main Road and the Si'ufaga Road thence on the direction to the coast and thence along the coast to the point of commencement and includes the villages of Satufia, Vaega, Faletoi, Pitonu'u and Si'ufaga.


CONSTITUENCY NO. 40 - PALAULI


All that area of land bounded as follows:


Commencing on the coast at the eastern boundary of Satupa'itea Electoral District and proceeding by the said boundary junction with Gagaifomauga No. 2 and No. 1 Electoral Districts, thence in a generally eastern direction by the southern boundary of Gagaifomauga No. 1 to its junction with Fa'asalele'aga No. 4 and No. 2 Electoral Districts, thence in a generally southerly direction by the western boundary of the Fa'asalele'aga No. 2 Electoral District to the boundary of Fa'asalele'aga No. 1 Electoral District, thence by the western boundary of Fa'asalele'aga No. 1 Electoral District to its south-west corner thence on a bearing of 190 degrees to the coast and thence along the coast back to the point of commencement and includes the villages and sub-villages of Vailoa, Vaito'omuli and Fa'aala.

Commencing on the coast at the eastern boundary of Palauli Electoral District and proceeding by the said boundary to its junction with Gagaifomauga No. 1 and Gagaifomauga No. 3 Electoral Districts, thence by its southern boundary Gagaifomauga No. 3 Electoral District to its junction with Gagaifomauga No. 2 and Satupa'itea Electoral Districts thence by the western boundary of Satupa'itea Electoral District to the coast and thence back to the point of commencement and includes the villages of Gataivai, Ga'utavai, Sili, Puleia and Papa.


And that area bounded as follows:

THE TERRITORIAL CONSTITUENCIES AMENDMENT ACT 1991
1991 No. 20


AN ACT to amend the Territorial Constituencies Act 1963 to prescribe two further constituencies entitled to elect one additional Member each, and to provide for the initial filling of those seats.


1. Short Title - This Act may be sighted as the Territorial Constituencies Amendment Act 1991 and shall read together with and deemed part of the Territorial Constituencies Act 1963 (hereinafter referred to as the Principal Act)


2. Title of Principal Act - The amendment contained in this section has been incorporated into the title of the Principal Act.


3. Prescribing 6 Territorial Constituencies entitled to elect one Member each - The amendment contained in this section has been incorporated into section 3 of the Principal Act.


4. By-elections held - (1) A by-election shall be held in each of the Territorial Constituencies of Safata and Salega to fill the additional seats prescribed by this Act, and the provisions of the Electoral Act 1963 shall apply to by-elections.


(2) The by-elections referred to in subsection (1) of this section shall be held upon such date or dates as the Head of State shall appoint, being a date not later than four calendar months after the date of the commencement of this Act.


5. Saving - Nothing in this Act shall affect the validity of any act done, or the conduct or result of any election held, before the commencement of this Act.


REVISION NOTES 1997


The Territorial Constituencies Act 1963 appearing in this reprint comprised that Act as it appears in the 1977 reprint together with the amendments contained in the Territorial Consitutencies Amendment Act 1991 as set out below:


Title: The expression "6" replaced the former figure "4" by section 2 of the 1991 Amendment Act.


Section 3: Section 3 was repealed and replaced by the present section 3 by section 3 of the 1991 Amendment Act.


Sections 4 and 5 of the 1991 Amendment Act have been printed at the end of the Principal Act.


REVISION NOTES 2008


This law has been generally edited as provided for by section 5 of the Revision and Publication of Laws Act 2008. The following general revisions have been made –


(a) References to Western Samoa have been amended to Samoa in accordance with an amendment to the Constitution of Samoa in 1997.


(b) Amendments have been made to conform to modern drafting styles and to use modern language as applied in the laws of Samoa.


(c) Other minor editing has been done in accordance with the lawful powers of the Attorney General.


There were no amendments made to this law since the publication of the Western Samoa Statutes Reprint 1978-1996.
