The Bankruptcy (Amendment) Rules 1980

The Lord Chancellor, in exercise of the powers conferred on him by section 132 of the Bankruptcy Act 1914(a), with the concurrence of the Secretary of State for Trade, and after consulting the committee appointed under section 10 of the Insolvency Act 1976(b), hereby makes the following Rules:-


1. These Rules may be cited as the Bankruptcy (Amendment) Rules 1980 and shall come into operation on 2nd February 1981.


2. The Bankruptcy Rules 1952(c) shall be amended as follows:-


(a) In Rule 129, for the figure "£20" there shall be substituted "£75".


(b) In Rule 178 the following paragraph shall be added:-


"(3) Upon any amendment to the title of the proceeding the Official Receiver [named therein] shall forthwith send notice thereof to the Chief Land Registrar with a request that the registration of the receiving order in the register of writs and orders affecting land be similarly amended [Form 33B]."


(c) In Rule 256(2) the words "upon payment of the prescribed fee" shall be deleted.


(d) For Forms 13A, 13B and 33A in Appendix 1 there shall be substituted respectively the forms set out in the Schedule to these Rules.


(e) After Form 33A in Appendix 1 there shall be inserted new Form 33B as set out in the Schedule to these Rules.

EXPLANATORY NOTE
(This Note is not part of the Rules.)


These Rules increase the deposit payable on setting down an appeal; amend the Forms to be sent to the Chief Land Registrar on the filing of a petition and making of a receiving order and prescribe a new form giving notice to him of any amendment to the title of the proceedings; and deletes the reference to a prescribed fee for examination of the list of proofs by the Chief Clerk in a County Court.
