LAND ACQUISITION (AMENDMENT) ACT

NO. 34 OF 2000

An Act to amend the Land Acquisition Act No. 5 of 1992 (the "Principal Act")


BE IT ENACTED by the President and Parliament as follows:

Repeal of sections

1. Paragraph 7(2)(e) and section 8 of the Principal Act are repealed.

Amendment of section 9

2. Section 9 of the Principal Act is amended by the adding at the end the following subsection:

"(2) A determination must be in writing and a copy of it must be given to the custom owner or owners of the land, and any other person interested in the land.".

Repeal of section

3. Section 11 of the Principal Act is repealed.

Repeal of section and substitution of new section

4. Section 12 of the Principal Act is repealed and the following section is substituted:

"Appeals

12 (1) Any custom owner or owners of the land or any other person interested in the land who is dissatisfied with a determination under section 9 may appeal to t he Supreme Court within 30 days after the date on which the determination is made.

(2) If a determination is made under section 9 and no appeal is made under subsection (1), the decision of the acquiring officer is final.".

Repeal of section and substitution of new section

5. Section 14 of the Principal Act is repealed and the following section is substituted:

"Payment of compensation

14 A compensation payment determined under section 9 is to be made to the custom owner or owners of the land, and any other person interested in the land, as soon as practicable after the appeal period under section 12 expires.".

Application of amendments

6. The amendments made by this Act apply in relation to a custom owner or owners of the land and any other person interested in the land, whether or not he or she or they have made a claim before this Act commences.

Commencement

7. This Act commences on the day on which it is published in the Gazette.
