CIVIL AVIATION (AMENDMENT)
ACT NO. 30 OF 2006

An Act to amend the Civil Aviation Act No. 16 of 1999.

Be it enacted by the President and Parliament as follows-

1. Amendment

The Civil Aviation Act No. 16 of 1999 is amended as set out in the Schedule.

2. Commencement

This Act commences on the day on which it is published in the Gazette.

AMENDMENTS OF THE CIVIL AVIATION ACT NO. 16 OF 1999

1. Arrangement of sections (30)

Delete "Minister", substitute "Director".

2. Subsection 23(1)

Delete "Subject to subsection (2), the", substitute "The".

3. Subsection 23(2)

Repeal the subsection.

4. Subsection 23(3)

Renumber the subsection as "(2)".

5. Subsection 23(4)

Renumber the subsection as "(3)".

6. Section 30 (heading)

Delete "Minister", substitute "Director".

7. Subsections 30(1)

Delete "Minister", substitute "Director".

8. Paragraph 30(1)(c)

Delete all the words from "Minister set" to and including "functions of the".

9. Subsection 30(4), and sections 31, 32, 33, and 34

Delete "Minister" (wherever occurring), substitute "Director".

10. Subsection 35(1)

Delete "Subject to subsection (2), the", substitute "The".

11. Subsection 35(2)

Repeal the subsection.

12. Subsection 35(3)

(a) Renumber the subsection as "(2)".

(b) Delete "Minister", substitute "Director".

13. Subsection 35(4)

Renumber the subsection as "(3)".

14. Subsection 36(2)

Repeal the subsection, substitute

"(2) The Director must sign all ordinary or emergency rules."

15. Subsections 36A(1), (3), and paragraph 36A(3)(b)

Delete "Minister" (wherever occurring), substitute "Director".

16. Subsection 37(2)

Delete all the words from "the Minister" to and including "as the case may be,",

substitute " the Director".

17. Paragraph 37(2)(h)

Delete "as the Minister or".

18. Subsection 38(1), subparagraph 38(1)(a)(i) and paragraph 38(1)(b)

Delete "Minister" (wherever occurring), substitute "Director".

19. Subsection 38(2)

Delete all the words from "Subject to" to and including "the Minister", substitute

"The Director".

20. Subsections 38(3), 39(6) and 39(7)

Delete "Minister" (wherever occurring), substitute "Director".

21. Paragraph 40(1) (d)

Delete all the words from "the Minister" to and including "as the case may be,"

substitute " the Director".
