An Act to amend the Business Licence Act [CAP 173].


BE IT ENACTED by the President and Parliament as follows:-


AMENDMENT OF SCHEDULE I OF THE BUSINESS LICENCE ACT [CAP 173]


1. The Business Licence Act [CAP 173] as amended is further amended in Schedule 1 as follows:


(a) Delete paragraph (iv) of the Remarks to Category B and substitute therefor the following new paragraph (iv) -


"(iv) Holders of a Class B licence are permitted to sell (retail/wholesale), without a D3 licence, through one outlet, those goods or products which they have processed or manufactured in Vanuatu. The one outlet is restricted to the manufacturing business headquarters or adjacent premises";


(b) Delete paragraph (iii) of the Remarks to Category C and substitute therefor the following new paragraph (iii) -


"(iii) Holders of Category C licences are not permitted to import and directly resell any materials, supplies, etc without holding D1 and D3 licences";


(c) Delete Category E7 including the words, figures and General Remarks appearing thereunder and substitute therefor the following new Category E7 -


"Category E7. Stevedoring and Wharf Facilities


All Wharfs - 2.00% of turnover for the licensing year.


General Remarks


(i) Includes such services as loading or unloading of ships, maintenance and operations of docks and wharfs (wharffingers).


(ii) Turnover means gross operational income from stevedoring activities including income from the carrying on of the business services set out in paragraph (i) above";


(d) Insert the following new paragraph (iii) immediately after paragraph (ii) of the Remarks to Category F2A -


"(iii) Excludes carrying on business as a conveyancer for which a separate F6 business licence is required";


(e) Insert the following new paragraph (iv) immediately after paragraph (iii) of the Remarks to Category F2B -


"(iv) Excludes carrying on business as a conveyancer for which a separate F6 business licence is required";


(f) Delete paragraph (ii) of the Remarks to Category F7 and substitute therefor the following new paragraph (ii) -


"(ii) Professionally qualified means a person who holds a qualification of one of the member accountancy bodies of the International Federation of Accountants and or a person holding a degree, diploma or certificate in accountancy from a tertiary institution";


(g) Insert the words "Chiropractors and Osteopaths" immediately after the words "Medical Practitioners" in the heading of Category G1A.


COMMENCEMENT


2. This Act shall come into force on the day of its publication in the Gazette.
