ORDER


UPON reading the Notice and Ground of Appeal filed in this case; and

UPON hearing the arguments and submissions of counsel, the Court makes the following Orders:

1. The grounds of the appeal are refused.

2. The appeal is dismissed.

3. The respondent is entitled to costs of Vatu 60,000 against the appellant.

4. The costs be paid within 6 months by instalments of Vatu 10,000 VT per month commencing by 31 May 2004.

5. Reasons of judgment be supplied in due course.
