ORDER


This case is brought before me for mention pursuant to the Order of the Magistrate’s Court dated 28th June, 2004.

The Court grants leave to Mr Bihu to appear on behalf of the Public Prosecutor. Mr Bihu seeks an order to refer the case back to the Magistrate’s Court for plea as it is a case that falls within the jurisdiction of the Magistrate’s Court. I have heard briefly from the Accused who appears to not object to the application. On that basis I now order that this case be vacated in the Supreme Court but that it be transferred back to the Magistrate’s Court for appropriate action.
