ORDER

UPON hearing Mr. Stephens for the appellant and Mr. Gardner for the Pubic Prosecutor it is hereby ordered that:-

“The Orders of the Learned Magistrate dated 22nd May 2001 are amended as follows

Order 1 - Remains
Order 2 - is deleted and substituted therefor is that the foreign

Fising Vessel Karya Wijaya 101 be released upon receipt

into the Trust Account of the Chief Registrar of a bond in a sum of cleared funds of Vatu 5.000.000, pursuant to section 27 Fisheries Act

Order 3 -remains

Order 4 - is deleted and substituted therefor is

“The defendant Chen Wen Jen be released from the custody of the Court to appear on the 11th June 2001 at 8.30 am upon receipt in the Trust Account of the Chief Registrar of a bond in the sum of cleared funds of Vatu 2.000.000 to be forfeited to the Republic of Vanuatu if the said defendant fails to appear on the date and at the time appointed in paragraph 3 hereof”
