TUVALU

TRAFFIC (AMENDMENT) ACT 1992
(Act 3 of 1993)

I assent

Sir Toaripi Lauti, PC, GCMG
Governor-General

18th March 1993

AN ACT to amend the Traffic Act, Cap 71.

(Commencement; ______________)

ENACTED by the Parliament of Tuvalu-

Short title and commencement

1. This Act may be cited as the Traffic (Amendment) Act 1992 and shall come into effect on such date as the Minister shall by notice appoint.

Amendment of Cap 71

2. The Traffic Act is amended by inserting the following new section-

"Offence 11A. Any person who contravenes any of the provisions of this part or who uses a motor vehicle or bicycle or being the owner permits such motor vehicle or bicycle to be used in contravention of such provisions or in contravention of any of the conditions of a licence issued in pursuance of any of the provisions of this Act is guilty of an offence."

TRAFFIC (AMENDMENT) ACT 1992
(Act 3 of 1993)

EXPLANATORY MEMORANDUM
(This memorandum is not part of the Act)

The purpose of this Act is to amend the Traffic Act by inserting a new provision which would make it an offence to contravene certain provisions of the Act. Such provisions restrict the doing of certain things but stop short of making it an offence their contravention. Section 6 of the Traffic Act is an example of such provisions.

This is an oversight which occurred when the Traffic Act was repealed and replaced by a new Act in 1983.
