PROVIDENT FUND (AMENDMENT NO. 2) ACT 2009

AN ACT TO AMEND THE PROVIDENT FUND ACT

ENACTED BY THE PARLIAMENT OF TUVALU
30th November, 2009

Commencement [1st January, 2011]

1 Short Title and Commencement

This Act may be cited as the Provident Fund (Amendment No.2) Act 2009 and shall come into effect on a day to be appointed by the Minister by Notice.

2 Amendments to section 20 of the Provident Fund Act 1984

Section 20 of the Act is amended as follows:

(i) Repeal subsection (1)(e)

(ii) Insert at the commencement of subsection (2) the words "Subject to subsection (2A)";

(iii) Insert after subsection (2) the following new subsection –

"(2A) The foregoing subsection (2) shall not be applied strictly against any active contributing member above the age of 65 who is still earning a steady income from any paid employment".

(iv) Omit "or (1)(e)" from subsection (4).

3 Amendment to section 23 of the Provident Fund Act 1984

Section 23(1) is amended by omitting paragraph "(e)".
