PENAL CODE (AMENDMENT) ACT 2014

AN ACT TO AMEND THE PENAL CODE TO PROVIDE A LIMITED DISCRETIONARY PENALTY RANGE FOR THE OFFENCE OF MURDER

ENACTED BY THE PARLIAMENT OF TUVALU

[Commencement Date 22 July 2014]

1 Short Title
This Act may be cited as the Penal Code (Amendment) Act 2014.

2 Penal Code Amendment
(1) Section 193 is repealed and replaced with the following —

"193 Murder Any person who of malice aforethought causes the death of another person by an unlawful act or omission is guilty of murder and shall be sentenced to imprisonment for a period not less than 15.

(2) Section 25 is amended by deleting "193" and "murder".
