CITIZENSHIP (AMENDMENT) ACT 2009


AN ACT TO AMEND THE CITIZENSHIP ACT TO REMOVE PROVISIONS RELATING TO THE LOSS OF CITIZENSHIP AND TO ALLOW THE REGISTRAR TO PROVIDE PEOPLE WITH EVIDENCE OF THEIR CITIZENSHIP.

Commencement [3rd December, 2009]


1 Short title and commencement


This Act may be cited as the Citizenship (Amendment) Act 2009 and shall come into effect the date of publication by exhibition.


2 Amendment of the Citizenship Act


The Citizenship Act (Cap. 98) is amended as follows:


(a) Insert a new section 4A:


"4A Evidence of Tuvaluan citizenship


(1) A person may make an application to the Registrar for evidence of the person's Tuvaluan citizenship.


(2) An application under subsection (1) must:


(a) be on the relevant form approved by the Minister; and


(b) contain the information required by the form; and


(c) be accompanied by any other information or documents prescribed by the regulations; and


(d) be accompanied by the fee (if any) prescribed by the regulations.


(3) The Registrar may give the person a notice stating that the person is a Tuvalu citizen at a particular time.


(4) The notice must:


(a) be in a form prescribed by the regulations; and


(b) contain any other matter prescribed by the regulations.


(5) The Registrar must not give the person such a notice unless the Registrar is satisfied of the identity of the person.


(6) A notice is prima facie evidence of the matters in the notice.


(7) The Registrar may, by writing, cancel a notice given to a person under this section."


(b) In section 6(4)(c) of the Citizenship Act replace the words:


"that he is and will be able to remain financially self-supporting;


" with the words "that he has personal assets to the value of at least $250,000;"


(c) In section 6(5) of the Citizenship Act omit the following text:


"(a) being a national or citizen of some other country, renounce such other nationality or citizenship; and


(b)"


(d) Omit sections 7(1) to 7(4) of the Citizenship Act and renumber the following subsections.
