TOURIST (AMENDMENT) ACT 1990


Act 16 of 1990


AN ACT TO AMEND THE TOURIST ACT


I assent,

7th November, 1990

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:


1. (1) This Act may be cited as the Tourist (Amendment) Act 1990.


(2) The Tourist Act 1976, as amended, is in this Act referred to as the Principal Act.


2. Section 2 of the Principal Act is amended:


(a) by inserting in the definition of "Tourist facility" between the words "includes" and "beach operator" the words "accommodation, restaurant,";


(b) by deleting the words "Tourist Officer" and the definition thereof, and replaced by the following in its alphabetical order:


""Director" means the Director of Tourism"


3. Section 4 of the Principal Act is amended by deleting the words "Tourist Officer" from subsections (1)(c) and (2) thereof and replaced with the word "Director".


4. Section 8 of the Principal Act is amended:


(a) by inserting in paragraph (b) thereof a comma after the word "overseas" and inserting thereafter the words "and foster internal and external accessibility and transportation for tourists and the public";


(b) by inserting in paragraph (d) thereof a comma after the word "language" and inserting thereafter the words "and to decide on a type of tourism development most in keeping with the interests of Tonga";


(c) by inserting in paragraph (1) thereof the words "cultural and historical activities", immediately before the words "scenic attraction";


(d) by deleting paragraph (q) thereof and replaced with the following:


"(q) to conduct market research, compilation of visitors statistics and any other research necessary or desirable for the purposes of this Act".


5. Section 9(1) of the Principal Act is amended by deleting the words "prescribed fee to the Deputy Commissioner of Inland Revenue" and replaced with the words "fee prescribed by the Licences Act".


6. Section 10 of the Principal Act is amended by inserting the following as subsections (3) and (4):


"(3) (a) Every applicant for a grant or renewal of a licensee shall submit to the Minister details of prices of tourist facility, accommodation, set meals, drinks, rental charges, commissions and such services as the Minister may from time to time specify, whether generally or in any specified case.


(b) The Minister having regard to the standard and quality of services provided in any licensed tourist facility may fix maximum charges to be used therein; If the charges used in any licensed tourist facility exceeds the fixed maximum charges, the licence may be revoked.


(c) The charges for the services provided in any licensed tourist facility shall be clearly displayed for the information of guests and the public. Any licensee contravening this provision may have his licence revoked.


(4) Statements, claims and representations contained in advertising material shall be accurate and capable of proof. Any licensee who publishes or causes or permits to be published any material that is not accurate may have his licence revoked".


7. Section 31 of the Principal Act is amended by deleting the words "Tourist Officer" and replaced with the words "The Director".
