AN ACT TO AMEND THE RETIREMENT FUND BOARD ACT

BE IT ENACTED by the King and the Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1 Short Title

(1) This Act may be cited as the Retirement Fund Board (Amendment) Act 2011.

(2) The Retirement Fund Board Act 1998, as amended, shall be referred to in this Act as the Principal Act.

2 Section 4 amended

Section 4 of the Principal Act is amended:

(a) in subsection (1), by deleting the words "3 Employer representatives, 2 Member representatives and the Chief Executive Officer" and replacing it with the words "3 Employer representatives and 3 Member representatives";

(b) in subsection (2):

(i) by deleting the words "Chairman of the Public Service Commission" and replacing them with "Cabinet Minister"; and

(ii) by repealing paragraphs (d) and (e) and replacing them with the following new paragraph (d):

"(d) 3 Member Representatives."; and

(c) in subsection (3):

(i) in the English version only, by deleting the number "2" wherever it appears and replacing it with the number "3"; and

(ii) in the Tongan version only, by repealing subsection (3) and replacing it with the following new subsection (3):

"(3) Ko e kau fakafofonga Memipa ko ha Memipa ia 'e toko 3 'oku fokotu'u hili hano fili 'e he kau Memipa, pe ko e memipa fetongi 'o e kau fakafofonga 'e toko 3 ko ia.".

3. Section 8 amended

The Principal Act is amended by repealing section 8 and replacing it with the following:

"8. The Chief Executive Officer shall perform the functions of the Secretary of the Board.".
