LEGISLATIVE ASSEMBLY (AMENDMENT) ACT 1989


Act 23 of 1989


AN ACT TO AMEND THE LEGISLATIVE ASSEMBLY ACT


I assent,

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:


1 Short title.


This Act may be cited as the Legislative Assembly (Amendment) Act 1989.


2 Commencement.


This Act shall come into force on a day proclaimed by His Majesty in Council and different sections of this Act may be brought into force on different dates.


3 Interpretation


The Legislative Assembly Act (Cap. 4) as amended is in this Act called the "Principal Act".


4 Repeal of Section 5.


Section 5 of the Principal Act is repealed.


5 Amendment of Section 6.


Section 6 of the Principal Act is amended by repealing the words "Section 9 of this Act" and replacing them with the following -
"the provisions of the Electoral Act, 1989".


6 Repeal of Sections 8, 9 and 18


Sections 8, 9 and 18 of the Principal Act are repealed.


7 Repeal of schedule.


The Schedule to the Principal Act is repealed.


8 Savings.


(1) Notwithstanding section 4 of this Act, any appeal made to an Electoral Appeal Committee and not determined before this Act comes into force, shall proceed and be determined as if section 5 of the Principal Act was not repealed by this Act.


(2) Notwithstanding the repeal of sections 8, 9 and 18 of the Principal Act, any prosecution commenced but not finalised before this Act comes into force, shall proceed as if sections 8, 9 and 18 of the Principal Act remained in force.


9 Transitional


(1) Notwithstanding Section 4 of this Act, for the purpose of an election held before 30 June 1990, paragraph (c), (d), (e), (f), (g) and (t) of Section 5 of the Principal Act shall be deemed to continue to operate.


(2) This section shall cease to have effect on 1 July 1990.
