AN ACT TO AMEND THE DISTRICT AND TOWN OFFICERS ACT TO REFLECT THE OPERATION OF THE ELECTORAL COMMISSION, AND FOR OTHER PURPOSES

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:


1 Short Title


This Act may be cited as the District and Town Officers (Amendment) Act 2012.


2 Section 6 amended


Section 6 of the District and Town Officers Act is amended by repealing subsections (3), (4) and (6) and replacing them with –


"(3) The Electoral Commission shall have the overall responsibility for organising and conducting elections under this Act in accordance with such procedure as it determines, and the Electoral Commission may make regulations for the purposes of –


(a) regulating the procedures to be followed at an election;


(b) any matter required to be carried out under the Act.


(4) The Prime Minister with the approval of Cabinet may appoint a date, not less than 40 days thereafter, for the holding of an election required to be held under this Act, and the Electoral Commission shall notify such date by Notice published in the Gazette in accordance with regulations.


(6) Nominations shall be received by the Supervisor of Elections not later than 21 days before the date of the election.".


3 Transitional


The District and Town Officers (Election) Regulations made on 2nd March 1965, as subsequently amended, are deemed to have been made by the Electoral Commission under section 6(3) and may be amended, repealed and replaced by the Electoral Commission.
