CRIMINAL OFFENCES (AMENDMENT) ACT 1997


Act 24 of 1997


AN ACT TO AMEND THE CRIMINAL OFFENCES ACT


I assent,
TAUFA'AHAU TUPOU IV,
2nd September, 1998

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:


1. Short Title


(1) This Act may be cited as the Criminal Offences (Amendment) Act 1997.


(2) The Criminal Offences Act (Cap. 18) as amended, is in this Act referred to as the Principal Act.


2. Section 106 of the Principal Act is amended by inserting a new paragraph (e) in subsection (2) thereof as follows:


"(e) the transmitting to another person, by any means, of the Human Immunodeficiency Virus (HIV)."


3. Section 133 of the Principal Act is amended in the English version only by inserting before the words "or nephew" wherever they appear the words "father's brother's son".


4. Section 150 of the Principal Act is amended by deleting all the words after the word "theft" where it first appears and substituting therefor the following—


", unless there are special reasons, no order shall be made preventing the trial at the same time of any number of such offences not exceeding 5, whether alleged to have been committed within 6 months from the first to the last of such offences against the same person or not. Nothing in this section shall prevent an indictment containing more than 5 counts from being presented."


5. Section 160 of the Principal Act is amended by deleting all the words after the word "respectively" where it first appears and substituting therefor the following—


", unless there are special reasons, no order shall be made preventing the trial at the same time of any number of such offences not exceeding 5, whether alleged to have been committed within 6 months from the first to the last of such offences against the same person or not. Nothing in this section shall prevent an indictment containing more than 5 counts from being presented."
