NATIONAL ELECTIONS RULES 2013

  1. Name

These are the National Elections Rules.

  1. Purpose

The purpose of these rules is to provide a common set of conditions for elections conducted in the villages for membership of the General Fono.

  1. Qualification of voters

A person is qualified to be a voter in elections for the General Fono if on 31 December of the year preceding the election that person –

(i) is at least 18 years of age, and
(ii) has been a resident in Tokelau for at least 6 consecutive months in the preceding 12 months, and
(iii) is neither a permanent resident in Tokelau nor a New Zealand citizen but has resided in Tokelau for at least one year prior to the election.
  1. Minimum qualifications of members of the General Fono

A member of the General Fono must, at the time of election as a member of the General Fono, –

(i) have resided in Tokelau for at least the 2 years immediately preceding election, and
(ii) be the holder of a current New Zealand passport, and
(iii) be at least 35 years of age.
  1. Designation by election

Members of the General Fono are elected in accordance with these Rules.

  1. Conduct of elections

(1)

(i) The Taupulega shall appoint a committee for the purpose of organising an election, supervising the voting, counting the votes, and declaring the result of the election.
(ii) No person who is a candidate for election can be a member of the committee.

(2) The Taupulega shall establish a list of candidates in accordance with the custom of the village.

(3) The Taupulega shall give public notice in the village of the time and place of an election, and of the list of candidates, at least 2 days before the election.

(4) At election time, each qualified voter of the village who is present at the voting place on election day may cast a secret vote to designate the person or persons to be members of the General Fono.

(5)

(i) In order to be elected a candidate must receive more than half the votes cast.
(ii) Election of members of the General Fono other than the Faipule and Pulenuku will follow the election of Faipule and Pulenuku. Rule 3 of the Constitution amended -Spent
