THE CONSTITUTIONAL OFFICES
(TERMS AND CONDITIONS OF SERVICE) (PUISNE JUDGE)
REGULATIONS 1995


IN exercise of the powers conferred by Section 3 of the Constitutional Offices (Terms and Conditions of Service) Act, the Prime Minister hereby makes the following Regulations -


1. These Regulations may be cited as the Constitutional Offices (Terms and Conditions of Service) Puisne Judge) Regulations 1995.


2. The term of office of the Puisne Judge is subject to the provisions of section 80 of the Constitution.


3. The function of the Puisne Judge shall be as prescribed under Part II of Chapter VII of the Constitution.

(1) The Puisne Judge shall be paid a taxable salary of............................. per annum.


(2) The salary of the Puisne Judge shall receive an annual increment at the rate of two-third of the inflation rate or consumer price index for the preceding year ending in December. The increase shall commence on the first day of January each year.


(3) The salary of the Puisne Judge shall be reviewed whenever there is a review of the salary of public servants by the Government and any increases given to public servants shall also apply to the salary of the Puisne Judge. The salary for the Puisne Judge shall not be affected by any reviews in which the salaries of public servants are to be reduced and which will result in the salary of the Puisne Judge being reduced.


5. The Puisne Judge shall contribute to the National Provident Fund as required under the provisions of the Solomon Islands National Provident Fund Act.


6. The Puisne Judge shall be provided with an official residence free of rent.


7. The cost of water, gas, electricity and telephone provided to the Puisne Judge’s official residence shall be charged to public funds and be paid for by the Government.


8. The wages payable for the services of a driver, a domestic employee and a gardener shall be charged to public funds and be paid for by the Government.

(1) The Puisne Judge shall be provided with a vehicle free of charge.


(2) The Puisne Judge shall be provided with a new vehicle once in every three years, and shall be of a class which is suitable on security grounds.


10. The Puisne Judge shall be entitled to leave at the rate of two months per annum for every year of service which shall be taken during the year in which it accrues or such time as approved by the Chief Justice.

(1) The Puisne Judge and the members of his family shall be provided with free air or sea passages, as appropriate, from Honiara to his place of domicile and return passages to Honiara.


(2) In this regulation ‘place of domicile’ includes place of domicile of his spouse outside of Solomon Islands, if the spouse is not a citizen of Solomon Islands.


12. The Puisne Judge shall be entitled to two return trips either by sea or air within Solomon Islands on compassionate leave per annum.


13.


(1) The Puisne Judge shall be entitled on official overseas travel to a daily allowance equivalent to the travel allowance paid to Ministers of the Crown on official overseas allowance travel, or where such travel is externally funded, at 50% of that daily allowance.


(2) Where the spouse of the Puisne Judge accompanies him on an official overseas visit, the spouse shall be entitled to claim subsistence allowance at the rate payable to the Puisne Judge under paragraph (1) of this regulation.


14.


(1) The Puisne Judge shall be entitled to travel first class on all overseas visits.


(2) The spouse of the Puisne Judge shall be entitled to travel first class on all overseas visits when accompanying the Puisne Judge on such visits.


15. The Puisne Judge shall be entitled to a daily allowance of ............................ whilst on official travel within Solomon Islands.


16. The person appointed Puisne Judge shall be entitled on his first appointment of an appointment grant of $2,000.00.

(1) The Puisne Judge shall be entitled to an outfit allowance of $700.00 when travelling overseas. The allowance may be claimed once every three years.


(2) The spouse of the Puisne Judge shall be entitled to claim outfit allowance at the rate payable to the Puisne Judge under paragraph (1) of this regulation.


18. The Puisne Judge shall be entitled to an entertainment allowance of $6,000.00 per annum.


19. The Puisne Judge shall be entitled to medical treatment free of charge in Government Hospitals and treatment overseas at Government expense.


20. The Puisne Judge shall be eligible for a Government guaranteed loan, the maximum amount which shall not guarantee exceed his annual basic salary.


21. The Puisne Judge shall be entitled to baggage allowance as prescribed by General Orders.


22. Where the Puisne Judge dies whilst in office, the Government shall pay for all funeral expenses and all other expenses incidental thereto.


23. The Puisne Judge shall be entitled to be paid an allowance of $300.00 per day when performing higher duties.


24. The Puisne Judge shall be entitled to a tax free termination benefit at the end of his term in office at the rate of two weeks’ pay for each completed year of service in the office.


25. The Puisne Judge shall be entitled to all other benefits available to public officers under General Orders or other regulations which are not covered under these Regulations.


26. The Government shall be responsible for providing adequate security at the residence of the Puisne Judge as well as at any other time.


27. The Constitutional Offices (Terms and Conditions of Service) (Puisne Judge) Regulations 1990 is hereby revoked.
