THE PRISONS (AMENDMENT) ACT 1999

Passed by the National Parliament this first day of December 1999.


Assented to in Her Majesty’s name and on Her Majesty’s behalf this tenth day of December 1999.

AN ACT TO AMEND THE PRISONS ACT (CAP. 111)


ENACTED by the National Parliament of Solomon Islands.


Short title.


1. This Act may be cited as the Prisons (Amendment) Act, 1999.


Insertion of new section 8A in Cap. 111.


2. The Prisons Act is hereby amended by inserting therein immediately after section 8 the following new section as section 8A -


"Employment of prison officers under command of Commissioner of Police.


8A. (1) The Prime Minister may, where it appears to him to be reasonably justifiable for the purposes of maintenance and enforcement of law and order, the preservation of peace and the protection of life and property, in writing order the Superintendent of Prisons to make available prison officers to be deployed under the command of the Commissioner of Police.


(2) Where prison officers are deployed under the command of the Commissioner of Police pursuant to subsection (1), such prison officers shall while on duty have the same powers, privileges and protection, including the carrying of arms, and shall be liable to perform the same duties as police officers.".
