THE CONSTITUTION (AMENDMENT) ACT 1992

Passed by the National Parliament this second day of December 1992.

AN ACT To Amend provisions of the Constitution of Solomon Islands which relate to the composition of the Judicial and Legal Service Commission.


ENACTED by the National Parliament of Solomon Islands.


Short title.


1. This Act may be cited as the Constitution (Amendment) Act 1992.


Amendment of section 117 of the Constitution.


2. Section 117 of the Constitution (hereinafter referred to as the “principal Act”) is hereby amended by deleting subsections (2) and (3) and substituting therefor the following new subsections as subsections (2) and (3) respectively -


"(2) The members of the Commission shall be -


(a) the Chief Justice, who shall be Chairman of the Commission;


(b) the Attorney-General;


(c) the Chairman of the Public Service Commission;


(d) the President of the Bar Association; and


(e) two other members.


(3) The two members referred to in paragraph (e) of subsection (2) shall be appointed by the Governor-General, acting in accordance with the advice of the Prime Minister.".


Amendment of Section 126.


3. Section 126 of the principal Act is hereby amended in the following respects -


(a) in subsection (5) by deleting the word "member" that appears before the words "of the Judicial and Legal Service Commission" and substituting therefor the word "members"; and


(b) in paragraph (a) of subsection (6) by deleting the words "removal of the member" that appear therein and substituting therefor the words "removal of a member".
