CHAPTER 136


ARMORIAL BEARINGS


AN ACT TO DECLARE THE ARMORIAL BEARINGS OF SOLOMON ISLANDS, TO PROHIBIT THE UNAUTHORISED USE THEREOF AND FOR MATTERS CONNECTED THEREWITH AND INCIDENTAL THERETO

Short title


1. This Act may be cited as the Armorial Bearings Act.


Interpretation


2. In this Act, unless the context otherwise requires—


"the Armorial Bearings" means the Armorial Bearings of Solomon Islands as published by the Minister in the Gazette after the commencement of this Act.


Prohibition


3.—(1) From the date of the commencement of this Act except with the written permission of the Minister, which may be given in general or particular terms, and subject to any conditions which the Minister may specify in the instrument of consent, no person shall—


(a) in any manner or in connection with any matter whatsoever, display in public, or sell or expose for or have in his possession for sale, or for any of those purposes make; or


(b) in connection with any business, trade, calling or profession, use,


any copy of the Armorial Bearings, or a device or thing so closely resembling the Armorial Bearings as to lead to the belief that the device or thing is the Armorial Bearings.


(2) Any person who contravenes subsection (1) is guilty of an offence and liable on conviction to a fine of one thousand dollars.


(3) The Court before which any person is convicted of an offence under subsection (1) may, in addition to imposing any other punishment, order that any goods or thing by means, or in respect of which the offence was committed shall be forfeited.


Restriction on proceedings


4. No proceedings for an offence against section 3 shall be instituted without the consent of the Director of Public Prosecutions.
