Gaming Machine Regulation 1993

ARRANGEMENT OF SECTIONS.

Gaming Machine Regulation 1993

MADE by the Head of State, acting with, and in accordance with, the advice of the National Executive Council under the Gaming Machine Act 1993.

  1. APPLICATION FOR A PERMIT OR RENEWAL THEREOF.

(1) An application for a permit under Section 25(1)(a) of the Act or for the renewal of a permit shall be on Form 1 of Schedule 1.

(2) An application for a permit under Section 25(1)(a) of the Act or for the renewal of a permit shall be accompanied with–

(a) a photocopy of the current valid liquor licence in respect of the premises the subject of the application; and

(b) a floor plan of those premises showing the area on which it is proposed to locate the gaming machines; and

(c) particulars of the financial resources of the applicant.

  1. FORM OF PERMIT.

A permit or the renewal of a permit shall be on Form 2 of Schedule 1.

  1. APPLICATION FOR VARIATION OF A PERMIT.

(1) An application for a variation of a permit shall be on Form 3 of Schedule 1.

(2) An application for a variation of a permit shall, in the case of a change in location or alteration of premises, be accompanied with–

(a) a photocopy of the current valid liquor licence in respect of the new location or altered premises; and

(b) a floor plan of the premises or altered premises showing the area on which it is proposed to locate the gaming machines.

  1. APPLICATION FOR A SPECIAL PERMIT.

(1) An application for a special permit shall be on Form 4 of Schedule 1.

(2) An application for a special permit shall be accompanied with–

(a) the Constitution or rules of the organization in respect of which the application is made; and

(b) a floor plan of the premises in respect of which the application is made showing the area on which it is proposed to locate the gaming machines; and

(c) details of the period in respect of which the special permit is sought.

  1. FORM OF SPECIAL PERMIT.

A special permit shall be on Form 5 of Schedule 1.

  1. APPLICATION FOR AUTHORITY TO DISPOSE OF AUTHORIZED GAMING MACHINE.

(1) An application by a site owner under Section 25(1)(b) of the Act to dispose of an authorized gaming machine shall be on Form 6 of Schedule 1.

(2) An application for authority to dispose of an authorized gaming machine shall be accompanied with particulars of the gaming machine or machines concerned and the reasons for its or their disposal.

  1. FORM OF PERMIT AUTHORIZING DISPOSAL OF A GAMING MACHINE.

A permit authorizing disposal of a gaming machine shall be on Form 7 of Schedule 1.

  1. APPLICATION FOR AN OPERATOR’S LICENCE OR RENEWAL THEREOF.

(1) An application for an operator’s licence or for the renewal of an operator’s licence shall be on Form 8 of Schedule 1.

(2) An application for an operator’s licence or for the renewal of an operator’s licence shall be accompanied with–

(a) the certificate of incorporation of the applicant corporation; and

(b) a copy of the Memorandum and Articles of Association of the applicant corporation; and

(c)[1] [Repealed.]

  1. FORM OF OPERATOR’S LICENCE.

An operator’s licence shall be on Form 9 of Schedule 1.

  1. RECORDS TO BE KEPT BY HOLDER OF AN OPERATOR’S LICENCE.

(1) The records required by Section 42 of the Act to be kept by the holder of an operator’s licence are as follows:–

(a) a record of each gaming machine operated by the holder of the licence including–

(i) the location of each gaming machine; and

(ii) the operation of each gaming machine; and

(iii) where a machine is withdrawn from operation, the date of and reasons for its withdrawal;

(b) all accounting details relating to gaming machines.

(2) The holder of an operator’s licence shall also keep an original copy of the agreement relating to gaming machines entered into with the holder of a permit.

  1. APPLICATION FOR GAMING MACHINE TECHNICIAN’S LICENCE.

(1) An application for a gaming machine technician’s licence or for the renewal of a gaming machine technician’s licence shall be on Form 10 of Schedule 1.

(2) An application for a gaming machine technician’s licence or for the renewal of a gaming machine technician’s licence shall be accompanied with–

(a) particulars of the applicant’s qualifications; and

(b) a copy of any certificate held by the applicant to the effect that he has successfully completed the Grade 1 Technician’s course.

  1. QUALIFICATION FOR HOLDING GAMING MACHINE TECHNICIAN’S LICENCE.

The qualification required by an applicant for a gaming machine technician’s licence is successful completion of the Grade 1 Technician’s course.

  1. FORM OF GAMING MACHINE TECHNICIAN’S LICENCE.

A gaming machine technician’s licence shall be on Form 11 of Schedule 1.

  1. ADVERTISEMENT OF APPLICATION.

(1) An advertisement under Section 53 of the Act shall be on Form 12 of Schedule 1.

(2) An advertisement under Section 53 of the Act shall contain the following particulars:–

(a) the name and address of the applicant;

(b) the nature of the application, whether for permit or renewal or variation, or special permit or operator’s licence or renewal, or a gaming machine technician’s licence or renewal thereof;

(c) the date by which, and the place at which, any written objection to the application may be lodged;

(d) the date on which, and the place at which, the application will be heard.

  1. INFORMATION TO BE PROVIDED PERIODICALLY BY HOLDER OF AN OPERATOR’S LICENCE.

(1)[2] [3]The prescribed period for the purposes of Section 64(1) of the Act is one month.

(2) The holder of an operator’s licence shall submit a report containing particulars of–

(a) the operation and turnover of the gaming machines in respect of which the operator’s licence was issued; and

(b) changes in the staff of the operator corporation; and

(c) changes in the corporate structure of the operator corporation.

(d)[4] gaming machines brought into Papua New Guinea but not yet installed and their location; and

(e)[5] gaming machine employees hired since the last report, including copies of their gaming machine certificates.

  1. MARKING OF MACHINES, ETC.

(1) The holder of an operator’s licence shall mark each gaming machine imported by him into Papua New Guinea as follows:–

(a) he shall allocate a separate number to each gaming machine; and

(b) he shall attach to the front of the machine a registration plate having engraved on it the number allocated under Paragraph (a); and

(c) he shall inscribe by electric pencil on the inside of the gaming machine the number allocated under Paragraph (a); and

(d)[6] [Repealed.]

(2) The holder of an operator’s licence shall, within seven days of allocating a number to a gaming machine under Subsection (1)(a), advise the Registrar of the number.

  1. AUTHORIZED POSSESSION OF GAMING MACHINE.

[7]A site owner may only be in possession of an authorized gaming machine where—

(a) the gaming machine has been imported into Papua New Guinea after the date of the coming into operation of the Act; and

(b) the gaming machine has been marked and registered in accordance with Section 16; and

(c) the gaming machine is the subject of an application for a permit or special permit by the site owner.

  1. WARNING TO MINORS.

A notice of warning to minors in Form 13 of Schedule 1 shall be displayed on premises in respect of which a permit is in operation.

  1. FEES.

Fees payable under the Act shall be as set out in Schedule 2.
