INDEPENDENT STATE OF PAPUA NEW GUINEA.


AN ACT

entitled

Forsayth Prize Fund Trust Act 1978,

Being an Act to make provision for the awarding of merit prizes to citizen pupils or students attending schools which are part of the National Education System.

  1. INTERPRETATION.

In this Act, unless the contrary intention appears–

“the National Education System” means the organization of schools and colleges and their administration established by the Education Act;

“school” means an institution for providing primary or secondary education, or both primary and secondary education, and includes an institution providing vocational or technical education, but does not include–

(a) an institution in which the instruction is wholly or mainly of a religious or doctrinal character; or

(b) an institution conducted by a church or mission for the exclusive purpose of training its own religious personnel; or

(c) a kindergarten, pre-school or other similar institution; or

(d) an institution conducted by the State which is not placed by the State under the authority of the Department of Education;

“the Trust” means the Forsayth Prize Fund Trust established under this Act;

“trustee” means the person referred to in Section 2.

  1. INCORPORATION.

The Secretary for Education is a corporation by the name of the Forsayth Prize Fund Trust with perpetual succession and a common seal, and, subject to this Act, with power to manage and control the property of the Trust.

  1. EXECUTION OF DEED, ETC.

Any deed or instrument executed or signed, and any other act, matter or thing done by the Trust shall be signed by the trustee under the common seal of the Trust.

  1. APPLICATION OF THE PUBLIC FINANCES (MANAGEMENT) ACT 1995.

Except where this Act provides to the contrary, the provisions of the Public Finances (Management) Act 1995 relating to the Trust Fund within the meaning of that Act apply to and in relation to the Trust.

  1. TRUST PROPERTY.

All property vested in the Trust shall be held on trust and dealt with in accordance with this Act, for the purposes of the promotion and encouragement of the education of citizens attending schools which are part of the National Education System.

  1. PRIZES.

(1) The income of the Trust shall be used by the Trust for the purchase of such prizes as it determines.

(2) The prizes referred to in Subsection (1) shall–

(a) be known as the Forsayth Prizes; and

(b) be awarded only to citizen pupils or students attending schools which are part of the National Education System; and

(c) be awarded by the Trust for merit as determined by the trustee.
