INDEPENDENT STATE OF PAPUA NEW GUINEA.


AN ACT

entitled

Employment Placement Service Act 1966,

Being an Act to provide for the establishment of an Employment Placement Service, and for other purposes, to be incorporated and read as one with the Native Employment Act 1958 (Adopted).

  1. ESTABLISHMENT OF EMPLOYMENT PLACEMENT SERVICE.

(1) The Employment Placement Service is hereby established.

(2) The Minister may, for the purposes of the Employment Placement Service, establish and maintain Employment Offices at such places as he thinks proper.

  1. FUNCTIONS OF EMPLOYMENT PLACEMENT SERVICE.

The functions of the Employment Placement Service are to provide services and facilities in relation to employment for the benefit of persons seeking to become employed or seeking to engage employees and in particular–

(a) to aid persons who have been trained to become employed in a manner best suited to their training, experience, abilities and qualifications; and

(b) to afford occupational advice, vocational guidance and other services to facilitate the engagement in employment and the continued employment of persons in the manner best suited to their experience, abilities and qualifications; and

(c) to provide such other advice and information services, and such other facilities in relation to employment or to matters connected with employment, as the Minister determines.

  1. EMPLOYMENT IN DECLARED AREAS.

(1) Where the Minister is satisfied that, in relation to an area, adequate arrangements have been made under the Employment Placement Service for the entry of persons in the area into employment as agreement workers he shall, by notice in the National Gazette, declare the area to be a declared area for the purposes of this section.

(2) Notwithstanding the Employment Act 1978, a person other than–

(a) an employer on his own behalf; or

(b) a person in the sole and full-time employment of the proposed employer and on behalf of the proposed employer,

who engages or attempts to engage for employment, as an agreement worker, a person within a declared area is guilty of an offence.

Penalty: A fine not exceeding K500.00.

(3) In a prosecution for an offence against Subsection (2), the onus of proving that he was at the material time a person referred to in Subsection (2)(a) or (b) is on the defendant.
