Defence (Transitional) Regulation 1975

ARRANGEMENT OF SECTIONS.

Defence (Transitional) Regulation 1975

MADE under the Defence Act 1974.

  1. PRESERVATION OF ORDERS, INSTRUCTIONS, DIRECTIVES, ETC., OF COMMANDER.

Subject to the Act, any regulations made under the Act or the Defence Council Orders, until other provision is made–

(a) all Routine Orders; and

(b) all Operations Orders and Instructions; and

(c) all Commander’s Directives; and

(d) all Staff Instructions; and

(e) all Command Training Directives; and

(f) all other orders, instructions or directives,

that applied, immediately before 6 March 1975 (being the date of commencement of the pre-Independence Defence (Transitional) Regulations 1975) to a member of the Defence Force of Australia or to that part of the Defence Force of Australia serving in Papua New Guinea, apply, with the necessary modifications, to the Defence Force and to all members of the Defence Force as if they had been issued under the Act.

  1. PRESERVATION OF MANUALS, INSTRUCTIONS AND DIRECTIVES OF THE MILITARY BOARD OF AUSTRALIA.

Subject to anything to the contrary in the Act, any regulations made under the Act, or the Defence Council Orders, until other provision is made under the Act–

(a) all manuals; and

(b) all instructions; and

(c) all written directives; and

(d) all regulations and instructions,

issued–

(e) by or under the authority of the Military Board of Australia established by the Defence Act 1903-1973 of Australia; or

(f) the Naval Board established by that Act; or

(g) otherwise under the powers contained in that Act or any Regulations made under that Act,

that applied to a member of the Defence Force of Australia or to that part of the Defence Force of Australia serving in Papua New Guinea, apply, with the necessary modifications, to the Defence Force and to all members of the Defence Force, as if they were issued by the person or body authorized under the Act to issue such manuals, instructions, written directives and regulations and instructions.

  1. PRESERVATION OF UNIT STANDING ORDERS, ETC.

Subject to anything to the contrary in the Act, any regulations made under the Act, or the Defence Council Orders, until other provision is made under the Act–

(a) all unit standing orders; and

(b) all unit and ships’ routine orders; and

(c) all training directives; and

(d) all operational orders; and

(e) all orders and instructions relating to the operation of aircraft,

that applied, immediately before 6 March 1975 (being the date of commencement of the pre-Independence Defence (Transitional) Regulations 1975) to a member of the Defence Force of Australia or to that part of the Defence Force of Australia serving in Papua New Guinea, apply, with the necessary modifications, to the Defence Force and to all members of the Defence Force as if they had been issued by the person or body authorized under the Act to issue such orders and directives.
