Act 54 of 1980


AN ACT to make provision for the prohibition of fishing on Sundays.


BE IT ENACTED by the Niue Assembly in Session assembled and by authority of the same as follows:


1. Short Title - This Act shall be cited as the Sunday Fishing Prohibition Act 1980.


2 .Interpretation - In this Act, unless the context otherwise requires -


"To fish" or "fishing" means taking, hunting, pursuing, catching or killing any fish by any means whatsoever.


"Sea-craft" means any vessel used at sea of whatever size and however propelled.


3. Sunday fishing prohibited - (1) No person shall be allowed to fish on a Sunday during the interval of four o'clock in the morning till nine o'clock at night.


(2) Any person contravening subsection (1) of this section shall be guilty of committing an offence against the provisions of this Act.


4. Sunday boating prohibited - (1) No person shall be allowed to use a sea-craft on a Sunday during the interval of four o'clock in the morning till nine o'clock at night.


(2) Any person contravening subsection (1) of this section shall be guilty of committing an offence against the provisions of this Act.


5. Powers to apprehend offenders - Any Police Officer shall have the power under this Act to arrest with or without warrant any person committing an offence or whom he has reasonable cause to be believe has committed an offence against the provisions of this Act.


6. Penalty - Any person offending against the provisions of this Act shall be liable -


(a) to a fine not exceeding $200; or


(b) to imprisonment for a term not exceeding 3 months; or


(c) to forfeiture to the Government of Niue the sea-craft together with its fishing gear and all fish taken.
