CIVIL LIST ORDINANCE 1966
1966, No. 34


An Ordinance to provide for the salaries of Elected Members of the Executive Committee and Niue Island Assembly
(1 March 1966).

PART I - INTRODUCTORY


1. Short Title and Commencement - (1) This Ordinance may be cited as the Niue Island Civil List Ordinance 1966.

(2) Parts II and III of this Ordinance shall be deemed to have come into force on the first day of September nineteen hundred and sixty-five. The balance of this Ordinance shall come into force on the day on which it is assented to by the Resident Commissioner.

2. Interpretation - In this Ordinance, unless the context otherwise requires -

"Act" Means the [Niue Act 1966]:

"Assembly" means the Niue Island Assembly:

"Clerk" means the Clerk of the Niue Island Assembly, or, if he is absent or the office is vacant, the Clerk-Assistant or other person for the time being performing the duties of the Clerk:

"Executive Committee" means the Executive Committee of Niue established by [section 9 of the Niue Act 1966].


[The Niue Act 1966, being the corresponding enactment in force at the date of this reprint, has been substituted for the Cook Islands Amendment Act 1964.]

PART II - EXECUTIVE COMMITTEE


3. Salary of elected Members of the Executive Committee - There shall be paid to each elected member of the Executive Committee a salary at the rate of four hundred and fifty pounds a year.

4. Period for which salary payable to elected Members of the Executive Committee - The salary of each elected member of the Executive Committee shall be payable in respect of the period commencing on the day on which he is elected pursuant to subsection (1) (b) of section 9 of the Act and ending on the day on which he ceases to be a member or vacates his office pursuant to subsection (2) of section 9 of the Act.

PART III - MEMBERS OF THE ASSEMBLY


5. Salary of elected Members of the Assembly - There shall be paid to each elected member of the Assembly to whom the provisions of Part II of this Ordinance do not apply a salary at the rate of two hundred pounds a year.

6. Period for which salary payable to elected Members of the Assembly - The salary of each elected member of the Assembly shall be payable in respect of the period commencing on the day on which a warrant declaring his election is signed by the Resident Commissioner and ending on the day preceding the day on which the members elected at the next ensuing general election take office, or on which he is declared by any law not to be eligible to sit or vote in the Assembly or to be disqualified from holding his seat, or on which his seat becomes vacant by death or otherwise, as the case may be.

PART IV - MISCELLANEOUS PROVISIONS


7. Appropriation of moneys for benefits and privileges - (1) The appropriation by the Assembly of moneys for the purpose of providing benefits or privileges of a specified kind for members of the Executive Committee or members or former members of the Assembly, or for the wives or children of any such persons, shall be sufficient authority for the grant of any such privileges, and where moneys are so appropriated they may be lawfully expended without any statutory authority other than this section and the Ordinance by which they are so appropriated.

(2) The operation of this section shall not be affected merely by any express statutory authority, other than this section, for the conferring of specified benefits or privileges:

Provided that nothing in this subsection shall be construed to authorise the expenditure of any money contrary to the express provisions of any Ordinance.

8. Payment only on Certificate of Clerk - No payment shall be made of any salary payable pursuant to the provisions of this Ordinance for any period except upon the certificate of the Clerk.

9. Grant for Civil Purposes - The several sums specified in this Ordinance s all be payable in every year out of the Niue Assembly Account as statutory expenditure.

10. Commission of Inquiry may be set up - (1) If at any time, owing to changed economic, financial or constitutional conditions in Niue or for any other reason, it is desirable to review the salaries to be paid to members of the Executive Committee or Assembly, the Resident Commissioner, acting on the advice of the Executive Committee, may appoint a Commission of Inquiry under the Commissions of Inquiry Act 1908, to inquire into and make such recommendations as it thinks fit as to the then adequacy or otherwise of the said salaries as specified in this Ordinance or in any Order made pursuant to subsection (2) of this section.

(2) After consideration of such recommendations the Resident Commissioner, acting on the advice of the Executive Committee, may by Order vary the salaries of members of the Executive Committee or the Assembly.

(3) Any Order under this section may specify different dates for the coming into operation of any variation in the salary of members of the Executive Committee or Assembly.

(4) While such Order is in force, the salaries fixed by the Order shall be payable out of the Niue Assembly Account as statutory expenditure instead of the salaries provided for in Parts II and II of this Ordinance.
