AN ACT

to amend the Liquor Amendment Act 1975.

1 Short title

(1) This Act may be cited as the Liquor Amendment Act 1998 and shall be read together with and deemed part of the Liquor Act 1975 (hereinafter referred to as "the principal Act").

(2) This Act shall be deemed to have come into force on the ... day of ... 1998.

2 Section 4(2) of the principal Act repealed and replaced

(1) Section 4(2) of the principal Act is repealed and the following subsection substituted:

"(2) Except as provided in section 5 of this Act it shall not be lawful for any person to import any liquor into Niue:

Provided that it shall be lawful for any person of or over the age of 18 years returning or entering into Niue to bring with him as part of his personal baggage and exempt from customs duty an amount that does not exceed:

(a) (i) 3.5 litres of spirits; or

(ii) 3.5 litres of liqueur; or

(iii) 3.5 litres of wine; or

(iv) any combination of (i) - (iii) above provided that the total volume does not exceed 3.5 litres; or

(b) 8.5 litres of beer."

The Niue Assembly passed this Act on the 26^th day of November 1998.
