AN ACT

to amend the Income Tax Ordinance 1961.

1 Short title

(1) This Act may be cited as the Income Tax Amendment Act 1999.

2 Interpretation

(1) In this Act "the principal Act" means the Income Tax Ordinance 1961.

3 Section 2 of the principal Act amended

(1) Section 2 of the principal is amended by omitting from the "salary and wages" heading, "and includes in periodic payment by way of superannuation, pension, retiring allowance or other allowance or annuity in respect of or in relation to past employment of that person or of any person of whom that person is or has been the wife, or husband, or a child, or dependant."

4 Section 49 of the principal Act amended

(1) Section 49 of the principal Act is amended by adding the following subsection at the end of the section -

"(w) Income derived from a periodic payment by way of superannuation, pension, retiring allowance or annuity in respect of or in relation to past employment of that person or any person of whom that person is or has been the wife, or husband, or a child or dependent.

5. Section 47 of the principal Act amended

(1) Section 47 of the principal Act is amended by repealing subsection (2).

The Niue Assembly passed this Act on the 24 day of June 1999
