STATUTORY SALARIES ACT 1974

AN ACT


To provide for the salaries and allowances of judges of the Supreme Court and the Clerk of Parliament.

STATUTORY SALARIES ACT 1974

AN ACT


To provide for the salaries and allowances of judges of the Supreme Court and the Clerk of Parliament.

Enacted by the Parliament of Nauru as follows:-


SHORT TITLE


1. This Act may be cited as the Statutory Salaries Act 1974.


SALARIES OF JUDGES AND THE CLERK OF PARLIAMENT TO BE FIXED BY REGULATIONS


2. (1) The Cabinet shall from time to time by regulations fix the salaries and allowances of judges of the Supreme Court and the Clerk of Parliament:


Provided that –


(a) the salaries and allowances payable to any person office of a judge of the Supreme Court or of the Clerk of Parliament shall not be altered to his disadvantage during the term of his appointment; and


(b) the salary and allowances of the Clerk of Parliament shall be fixed by the Cabinet only after consultation with the Speaker.


(2) The salaries and allowances payable to judges of the Supreme Court and the Clerk of Parliament shall be paid out of, and be a charge upon, the Treasury Fund.


SALARIES AND ALLOWANCES OF JUDGES AND THE CLERK OF PARLIAMENT BEFORE THE COMMENCEMENT OF THIS ACT


3. For the avoidance of doubt it is hereby declared that all salaries and allowances paid in respect of any period before the commencement of this Act to judges of the Supreme Court and to the Clerk of Parliament are to be deemed for all purposes to have been salaries and allowances prescribed by law.
