AN ACT


To make interim provision for the withdrawal and expenditure of monies from the Treasury Fund to meet the expenditure of the Republic for the period from the first of July Two thousand and five to the thirtieth day of September, Two thousand and five.

BE IT ENACTED by the Parliament of Nauru as follows:


SHORT TITLE


1. This Act may be cited as the Supply Act 2005.


INTERPRETATION


2. In this Act:


'the Treasury Fund' means the fund established under Article 58 of the Constitution of Nauru.


'the financial year' means the year commencing on the first day of July Two Thousand and four and ending on the thirtieth day of June, Two Thousand and five, inclusive of both dates.


'head' means a department or division of the expenditure of the Republic listed in the schedule to this Act.


'subhead' means a subdivision of a head.


COMMENCEMENT AND EXPIRY


3. This Act shall come into force on the first day of July, Two Thousand and Five and shall cease to have effect on the thirtieth of September Two Thousand and Five.


WITHDRAWAL OF MONEYS FROM THE TREASURY FUND


4. (l) A total sum not exceeding $3,319,150 may be withdrawn From the Treasury Fund and expended as authorised in the Schedule to this Act.


(2) Where the Cabinet considers it necessary to increase the amount assigned in the estimates to a particular subhead within a Head, the Cabinet may direct that there shall be applied to the aid of that subhead a further sure out of any surplus arising on any other subhead within the same Head, but so that the total amount withdrawn and expended does not exceed the amount authorised for that Head in the Schedule to this Act.


(3) Where the Cabinet authorises a transfer of funds between subheads within a Head in accordance with sub-section (2), it shall cause to be laid before the Parliament at the first meeting of the Parliament after it has approved the transfer, a copy of the order of the Cabinet approving such transfer.
