Enacted by the Parliament of Nauru as follows:


1 Short title


This Act may be cited as the Motor Traffic (Amendment) Act 2016.


2 Commencement


This Act commences upon certification by the Speaker.


3 Amendment of Motor Traffic Act 2014


The Motor Traffic Act 2014 is amended by the provisions of this Act.


4 Amendment of Section 57 (1)


Omit the words


'with an engine of a 100 cc or greater'


The new section 57(1) will now read:


'A person must not drive or ride on a road a motorcycle unless the person is wearing a safety helmet that is securely fastened'.


5 Insert new section 67A


67A Dangerous driving occasioning death

(1) A person is guilty of the offence of dangerous driving occasioning death if the motor vehicle driven by the person is involved in an impact occasioning the death of another person and the driver was, at the time of the impact, driving the motor vehicle:

(2) A person convicted for an offence under this section is liable upon conviction to imprisonment for 10 years.

6 Insert new section 67B


67B Dangerous driving occasioning grievous bodily harm

(1) A person is guilty of the offence of dangerous driving occasioning grievous bodily harm if the motor vehicle driven by the person is involved in an impact occasioning grievous bodily harm to another person and the driver was, at the time of the impact, driving the motor vehicle:

(2) A person convicted for an offence under this section is liable upon conviction to imprisonment for 7 years.
