MOTOR TRAFFIC (AMENDMENT) ACT 1971

AN ACT


To amend the Motor Traffic Ordinance 1937-1967.

AN ACT


To amend the Motor Traffic Ordinance 1937-1967.

Be it enacted by the Parliament of Nauru as follows:


SHORT TITLE


1. (1) This Act may be cited as the Motor Traffic (Amendment) Act 1971.


(2) The Motor Traffic Ordinance 1937-1967 is herein referred to as the Principal Ordinance.


(3) The Principal Ordinance as amended by this Act may be cited as the Motor Traffic Act 1937-1971.


2. Subsection (3) of Section 21 of the Principal Ordinance is repealed and the following subsection inserted in its stead:


"(3) The licence to drive a motor vehicle of a person convicted under this section:


(a) shall be suspended for six months; or


(b) may be suspended or cancelled for such longer period and upon such conditions as the Court which convicts him so orders.


3. Section 28 of the Principal Ordinance is repealed and the following section inserted in its stead:


"28. A person shall not drive a motor vehicle upon a public highway:


(a) at a speed exceeding thirty miles per hour; or


(b) at a speed exceeding fifteen miles per hour;


(i) while passing a school at a time when children are or are likely to be entering or coming out of school;


(ii) while passing a church at a time when the congregation is or is likely to be entering or coming out of church;


(iii) while passing a hospital;


(c) at a speed exceeding such speed as may be specified by Cabinet in respect of any public highway or part thereof and notified in the Gazette."
