An Act to amend the Legislation Publication Act 2011.

Certified on 5 December 2013

Enacted by the Parliament of Nauru as follows:

1 Short title

This Act may be cited as the Legislation Publication (Amendment) Act 2013.

2 Commencement

This Act commences 7 days after certification or at a date notified by the Minister in the Government Gazette.

3 Amendment of long title

Delete

'An Act relating to the publication of legislation, to establish the Office of Parliamentary Counsel and for related purposes'

Substitute

'An Act relating to the publication of legislation and for related purposes'.

4 Amendment of Definitions

4.1 Delete the following definitions:

Deputy Parliamentary Counsel, Office of Parliamentary Counsel and Parliamentary Counsel.

4.2 Insert the following in alphabetical order:

'The Department' means the Department of Justice and Border Control.

'The Minister' means the Minister for Justice and Border Control.

5 Delete Part 3 (sections 12–18)

6 Delete

All references to Office of Parliamentary Counsel, Deputy Parliamentary Counsel and Parliamentary Counsel.

Substitute

Department of Justice and Border Control

7 Insert New Section 12

(1) The following functions shall be performed by the Department:

(a) draft proposed laws for introduction into Parliament; and

(b) draft amendments to proposed laws that are being considered by Parliament; and

(c) draft proposed subsidiary legislation; and

(d) perform functions under this Act; and

(e) perform functions incidental to the functions mentioned in paragraphs (a) to (d).

(2) The provisions of section 12(1) shall not inhibit any other functions that may be delegated to the Department by the Minister.

(3) The Department may not delegate any of its functions under this Act.

8 Renumber other provisions in the Act accordingly

9 Amend other legislation

This section shall amend all other legislation referring to the Office of Parliamentary Counsel, Deputy Parliamentary Counsel and Parliamentary Counsel and substitute with 'The Department of Justice and Border Control'.
