FAMILY COURT AMENDMENT ACT

Enacted by Parliament of Nauru as follows:

SHORT TITLE

1. This Act may be cited as the Family Court (Amendment) Act 2005.

INTERPRETATION

2. In this Act, the 'principal Act' means the Family Court Act 1973.

AMENDMENT TO SECTION 2 OF THE PRINCIPAL ACT

3. Section 2 of the principal Act is amended by adding the words 'or a person appointed by the President after consultation with the Chief Justice' after the words 'means the resident magistrate'.

AMENDMENT TO SECTION 4 OF THE PRINCIPAL ACT

4. Section 4 of the principal Act is amended -

(a) in subsection (1) by adding the words 'or a person appointed under subsection (2A)' after the words 'the office of resident magistrate'.

(b) by adding thereto the following new subsection - '(2A) where the resident magistrate is unavailable for whatever reason, a person may be appointed by the President after consultation with the Chief Justice to act as Chairman of the Family Court during the period of unavailability of the resident magistrate'.

(c) in subsection (3), after the words 'Members of the Family Court' add the following words 'and any person appointed under subsection (2A)'.
