Enacted by the Parliament of Nauru as follows:

1 Short title

This Act may be cited as the Electoral (Amendment) No. 2 Act 2016.

2 Commencement

This Act commences upon certification by the Speaker.

3 Amendment of Electoral Act 2016

The Electoral Act 2016 is amended by the provisions of this Act.

4 Amendment of section 57(3)(d)

Section 57(3)(d) is amended as follows:

Omit

'$2000'

Substitute

'$500'

5 Amendment of section 63

Section 63 (3) is amended by:

(a) omitting the phrase 'of subsection (1)' in line 3; and
(b) substituting with the words 'of affording an opportunity to vote to every voter who are for the time being resident in their own homes or other places and not in any of the institutions specified in subsection (3)(a) of section 79, and who, are of sound mind and have expressed a willingness to vote, but by reason of illness or infirmity, or, in the case of a woman by reason of approaching maternity, is unable to attend to a polling station to record their vote'.

The clause will now read:

(3) Despite subsection (2), in exceptional circumstances, and on good cause being shown, additional polling stations may be designated by the Electoral Commissioner for the purposes 'of affording an opportunity to vote to every voter who are for the time being resident in their own homes or other places and not in any of the institutions specified in subsection (3)(a) of section 79, and who, are of sound mind and have expressed a willingness to vote, but by reason of illness or infirmity, or, in the case of a woman by reason of approaching maternity, is unable to attend to a polling station to record their vote'
