Electoral Act (Amendment) Act 2007

REPUBLIC OF NAURU

(No. 6 of 2007)

AN ACT

To impose a deposit fee for nominations for election and a fee upon the change of electorates.

ENACTED by the Parliament of Nauru

SHORT TITLE

1. This Act is the Electoral Act (Amendment) Act 2007.

PRINCIPAL ACT

2. (1) The Electoral Act 1965-1992 is called the principal Act.

(2) The principal Act as amended by this Act may be cited as the Electoral Act 1965-2007.

NOMINATION DEPOSIT

3. The principal Act is amended by inserting after section 16(2)–

“(2A) A nomination form must not be accepted under subsection (2) unless it is accompanied by payment of a cash nomination fee of $50.

(2B) The nomination fee must be paid into the Treasury Fund.”

CHANGE OF ELECTORATES

4. The principal Act is amended by inserting after section 9 –

“Application for change of enrolment

9A. An application by an elector to transfer an existing registration on a roll for a District to the Roll of another District change must not be accepted or the transfer of registration given effect until the applicant pays a transfer fee of $10 in cash in respect of the application.”

AMENDMENT TO FORMS IN THE SCHEDULE

5 (1) Form I in the Schedule of the principal Act is amended –

(a) by inserting after paragraph 8 –

‘9.1 attach my transfer fee of $10.”; and

(b) by inserting at the foot of the Form –

“Note: the transfer fee is not payable by a person who has never been enrolled as an elector.”

(2) Form 6 of the Schedule of the principal Act is amended by inserting after the words ‘I hereby consent to the above nomination’ –

‘and my cash nomination fee of $50 is delivered herewith.’

EFFECTIVE DATE

6. This Act has effect from 1 July 2007.
