Enacted by the Parliament of Nauru as follows:

1 Short title

This Act may be cited as the Criminal Code (Amendment) Bill 2015.

2 Commencement

This Act commences upon certification by the Speaker.

3 Act Amended

The Schedule amends the Criminal Code 1899.

SCHEDULE - AMENDMENT OF CRIMINAL CODE 1899

[1] Insert new section 244A

244A Publication of certain materials and statements A person who makes or publishes any statement or material:

(a) that coerces, intimidates, harasses, or causes emotional distress to a person; or

(b) uses language that is threatening, abusive or insulting in nature and with the intent to stir up racial, religious or political hatred; and

(c) such statement or material is likely to threaten national defence, public safety, public order, public morality or public health,

is guilty of an offence punishable on conviction, to imprisonment for a period not exceeding 7 years.
