JUDICIAL COMPENSATION (RESTORATION) ACT OF 2007

An Act


To amend the Judicial Compensation Act 1983.

BE IT ENACTED BY THE NITIJELA OF THE MARSHALL ISLANDS:


Section 1. Short Title.

This Act may be cited as the Judicial Compensation (Restoration) Act of 2007.

Section 2. Amendments.

The Judicial Compensation Act 1983, 27 MIRC Chp. 4, is amended as set forth below.

(1) Section 402 is amended to read as follows:

§402. Compensation otherwise than in the Community Courts.


(1) The annual salaries of judges, other than judges of the Community Courts, are as follows:

Chief Justice of the Supreme Court
$30,000
Associate Judge of the Supreme Court
$25,000
Chief Justice of the High Court
$70,000
Associate Justice of the High Court
$60,000
Presiding Judge of the District Court
$33,000
Associate Judge of the District Court
$30,000
Chief Judge of the Traditional Rights Court
$33,000
Associate Judge of the Traditional Rights Court
$30,000


(2) The judges are also entitled to an annual cost of living adjustment at the beginning of each fiscal year commencing with FY 2009 in an amount equal to the change in the consumer price index from the start of FY 2008, as determined by the Economic Policy, Planning, and Statistics Office, in addition to other allowances and other benefits as provided for contract officers of the Public Service.

(3) In each case the compensation is subject to the usual deductions from salary.

Section 3. Effective Date.

This Act shall take effect on the date of certification in accordance with Article IV, Section 21 of the Constitution.

(1) That Nitijela Bill No:155 was passed by the Nitijela of the Marshall Islands on the 27th day of September, 2007; and

(2) That I am satisfied that Nitijela Bill No:155 was passed in accordance with the relevant provisions of the Constitution of the Republic of the Marshall Islands and the Rules of Procedures of the Nitijela.
