CITIZENSHIP (AMENDMENT) ACT, 2009.

AN ACT

to amend section 403(7) of the Citizenship Act, in order to clarify the definition of the period of residence.

ENACTED BY THE NITIJELA OF THE REPUBLIC OF THE MARSHALL ISLANDS

Section l. Short Title.

This Act may be cited as the Citizenship (Amendment) Act, 2009.

Section 2. Amendments.

(i) Section 403(7) of the Citizenship Act, 1984 is hereby amended as follows:

§403. Citizenship by naturalization; general

(7) For the purposes of determining the period of residence of any person in the Republic, a period of residence shall not include:-

(a) any period during which the person was not legally in the Republic as an immigrant;

(b) any period during which a foreign worker is granted entry into the Republic under the Labor (Non-Resident Workers) Act, 2006 or on or after the effective date of this Act;

Section 3. Effective Date.

This Act shall take effect upon certification in accordance with the Constitution and the Rules of Procedures of the Nitijela.

(1) That Nitijela Bill No.:44 was passed by the Nitijela of the Republic of the Marshall Islands on the 13th day of May, 2009; and

(2) That I am satisfied that Nitijela Bill No.: 44 was passed in accordance with the relevant provisions of the Constitution of the Republic of the Marshall Islands and the Rules of Procedures of the Nitijela.
