§601. Short title.


This Act may be cited as the "Motorcycle and School Bus Safety Act"


§602. Headgear required.


All operators and passengers of two-wheel motor vehicles being operated on any street or highway shall wear on their heads safety helmets which shall be so constructed and so worn as to effectively reduce head injuries in case of accident. [D.L. 14-19 (1966); M.I. Code (1975), §14.201.]


§603. Passengers.


All operators of two-wheel motor vehicles being operated on any street or highway shall not:


(a) carry more than one passenger at any time; or


(b) carry any passenger less than twelve (12) years of age between 6p.m. and 6 a.m. [D.L. 14-19 (1966); M.I. Code (1975), §14.202.]


§604. Penalties.


Violation of any provision of Section602 or 603 of this Act shall constitute a misdemeanor and shall upon conviction be liable to a fine not exceeding $100 or to a term of imprisonment not exceeding thirty (30) days, or both. [D.L. 14-19 (1966); M.I. Code (1975), §14.203.]


§605. Traffic rules.


The driver of a vehicle on any road upon meeting or overtaking from either direction any school bus which has stopped on the highway for the purpose of receiving or discharging school children, shall stop the vehicle before reaching such school bus when the operator thereof is operating the visual signal as specified in Section 607 of this Act. Such driver shall not proceed until the school bus resumes motion, or until he is signaled by the school bus driver to proceed, or until the visual signal is no longer operated. §606. Bus markings.


Every bus used for the transportation of school children shall bear upon the front and rear thereof plainly visible signs containing the words "school bus". When a school bus is being operated upon a highway for purposes other than the actual transportation of children either to or from school, all markings thereon indicating "school bus" shall be covered or concealed. §607. Bus signals.


Every bus used for the transportation of school children shall be equipped with a red flag. The operator of such a bus shall hold such flag out of the window when stopping to receive or discharge school children, and shall withdraw the flag when the bus resumes motion. §608. Penalties.


(1) Any person who violates Section 604 of this Act shall be guilty of a misdemeanor and shall upon conviction be liable to a fine not exceeding $100 or to a term of imprisonment not exceeding thirty (30) days, or both.


(2) The owner of any school bus which is not equipped as required by Sections 606 and 607 of this Act shall be guilty of a misdemeanor and shall upon conviction be liable to a fine not exceeding $100. [D.L. 18-1 (1971); M.I. Code (1975), §14.254.]
